DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 20, Puget Sound Health Care System, Tacoma, Washington. 2.Description of Action: This is a request for other than full and open competition for the preventive maintenance service on four (4) Draeger Fabius GS Anesthesia units. The proposed is a sole source action to be awarded to: Draeger Medical, Inc 3135 Quarry Road Telford, PA 18969 1-800-543-5047 3.Description of Supplies or Services: Draeger will perform preventive maintenance on the following Draeger Fabius Anesthesia units: Serial numbers; 11301, 11423, 11288, and 11302. 4.Statutory Authority: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; (x) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5.Validity of Use of Statutory Authority: In accordance with 6.302-2, Unusual and Compelling Urgency, this is an emergency purchase request that will affect patient care if these anesthesia units are not serviced immediately. 6.Actions to Promote Competition: None. This is a proprietary system with very limited sources. 7.Determination of Fair and Reasonable Price: The estimated price to the Government is $3,540.00 and is determined to be fair and reasonable based on historical cost of previous services performed. 8.Market Survey (FAR 10): Market research was not conducted due to the compelling urgency of this requirement. 9.Other Considerations: The continuous downtimes of the Draeger Fabius Anethesia units will have a critical impact on surgical care for our veterans. 10.Listing of Sources that expressed, in writing, an interest in the acquisition: None 11.Statement of Actions to Overcome Barriers to Competition: In the event of future requirements, market research will be conducted for potential contractors that are authorized to perform maintenance on Draeger Anesthesia units. 12.Requirements Certification: I certify that the requirement outlined in this justification is a bonafide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. //SIGNED//2/22/2010 _____________________________________________________ Name: David ClarkDate Title: Biomedical Engineer Facility: VA Puget Sound Health Care System Approvals in accordance with FAR 6.304 a.Contracting Officer's Certification: (required) I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. //SIGNED//2/23/2010 _____________________________ ________________________ Name: Craig S.
