- DEPARTMENT OF VETERAN AFFAIRS PALO ALTO HEALTH CARE SYSTEM 3801 MIRANDA AVENUE PALO ALTO, CALIFORNIA 94304 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following Justification and Approval, the proposed contract described below may be established through other than full and open competition pursuant to the authority of 38 U.S.C. 8127(c) as implemented by IL 049-07-08, 41 U.S.C. 253(c)(5), and FAR 6.302-2(a)(2), Unusual or Compelling Urgency. 1.CONTRACTING AGENCY: The Department of Veterans Affairs, VISN 21, Consolidated Contracting Agency is responsible for the contracting action as described herein and will enter into a contract that requires justification for other than full and open competition. The solicitation number is VA-261-10-RP-0102. 2.DESCRIPTION OF ACTION: The request is being procured exclusive of competition, for a specific vendor, on a sole-source basis. The award will be made to Hughes Group, LLC, as a firm fixed price contract. The projected period of performance is a basic year plus four option years. 3.DESCRIPTION OF SUPPLIES/SERVICES: This procurement is for nonaseptic janitorial services at the VA Palo Alto Research Facility, 701 and 733 N. Shoreline Blvd., Mountain View, CA 94043-3208. The estimated price of the contract is $350,000.00. 4.AUTHORITY CITED: This service is being procured pursuant to FAR 6.302-2(a)(2). The preceding cited authority provides for purchase from a sole source when there is an unusual or compelling urgency such that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. 5.ANNOUNCEMENT OF REQUIREMENT: This solicitation was advertised in Fedbizopps as a direct award due the authority cited in #4 above. 6. EFFORTS TO OBTAIN COMPETITION: Due to the circumstances described in #4 above, competition will apply to this action. Additionally, it should be noted the previous contrct was issued for only one year, on the belief that the Research Department would only be at the Shoreline facility for one year, while their on-campus facility was enlarged and renovated. Sometime during the course of this year, a determination was made, changing Research's intended occupancy at Shoreline to an indefinite period. Therefore, a new contract needs to be executed. The follow-on award would have been to the incumbent, Corners Construction, however Corners is currently under investigation concerning their Service-Disabled Veteran Owned Small Business status. Until further notice, the SAO West Director has stated no awards are to be made to Corners. this direction came at a time close to the end of Corner's on year contract, therefore there is no time to conduct a competition by the time it ends, on February 28, 2010. 7.FAIR AND REASONABLE DETERMINATION: A Price Negotiation Memorandum will be prepared which will detail the actions taken by the Contracting Officer to ensure fair and reasonable pricing.
