Description
The department of State intends to award a firm fixed price delivery order on a sole-source basis to Herman Miller Inc, 855 E. Main Ave., Zeeland, MI 49464-1372. The award is to purchase office furniture/equipment, installation of new furniture and reconfiguration of the existing furniture. No award will be made on the basis of offers received in response to this notice. Responses to this notice must show clear and convincing evidence that competition would be advantageous to the Government. If no affirmative written response is received, the order will be awarded without further notice. A determination by the Government not to compete this proposed award based on this notice is solely within the discretion of the Government. Detailed capabilities must be submitted via email to the following email address no later than 3:00 pm., Eastern Stardard Time, March 4, 2010; JonesPW@state.gov JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (DOMESTIC CONTRACTING ACTIVITIES) 1. Identification of agency and contracting activity: The agency is the U.S. Department of State, Bureau of Global Systems, Charleston, SC 29405 (843) 308-5302. It is recommended that a purchase order be awarded to Herman Miller, Inc, of Zeeland, MI. 2. Nature and/or description of the action being approved. RM/GFSC, Administrative Operations (ADO), requires reconfiguration services for the 1st floor of building A. The requirement includes the purchase of new office furniture/equipment, installation of the new furniture and reconfiguration of the existing furniture. In 2004, Global Financial Service Center entered into an authorized Department of State construction project with/under Hightower Construction in reference to Building “C” and Renovations to Buildings “A” and “B” under contract N62467-00-C-0400, HCC Job no. 5641. At that time, GFSC purchased, furnished and installed Herman Miller Office Equipment (desks, chairs, cubicles and cubicle components) through Alfred Williams & Company. In upholding and maintaining consistent and proper department protocol, Global Financial Services requires procurement of Herman Miller Office Equipment off GSA contract (GS-28F-8049H). GFSC is also recommending Alfred Williams & Company (Herman Miller reseller) provide the equipment, deliver and install the procurement request. If another reseller is awarded this procurement request, they must be able to provide the same protocol to complete the scope of work provided by Alfred Williams & Company. 3. A description of the supplies or services required meeting the agency’s needs. The reconfiguration services for the 3rd floor of building B includes the purchase of new office furniture/equipment, installation of the new furniture and reconfiguration of the existing furniture. Herman Miller desks, chairs, cubicles and cubicle components are the only furniture/equipment that will match the existing furniture throughout GFSC. 4. An identification of statutory authority permitting other than full and open competition. The statutory authorities permitting other than full and open competition are as follows: 41 USC 253(c) (1), FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. 5. Demonstration that the proposed contractor’s unique qualifications or nature of the acquisition requires use of the authority cited. In 2004, GFSC purchased, furnished and installed Herman Miller Office Equipment (desks, chairs, cubicles and cubicle components) through reseller Alfred Williams & Company. In upholding and maintaining consistent and proper department protocol, Global Financial Services requires procurement of Herman Miller Office Equipment off GSA contract (GS-28F-8049H). 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. Efforts to solicit offers will be attempted utilizing FedBizOpps to publicize the requirement. 7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer determined the anticipated cost to the Government will be fair and reasonable based on the following documents provided by the vendor: Current purchase order and historical pricing data in contract files for the same work. 8. A description of the market research conducted and the results or statement of the reason a market was not conducted. Limited market research was completed for this project because Herman Miller is the only vendor able to provide furniture/equipment that will match the existing furniture throughout GFSC. This is a reconfiguration project. No other manufacturer’s parts and pieces will fit with the existing Herman Miller product. 9. Any other facts supporting the use of other than full and open competition. There are no further facts supporting the use of other than full and open competition. 10. A listing of sources, if any, that expressed in writing, an interest in the acquisition: “Notice of Intent to Sole Source” will be publicized on FedBizOpps to afford potential sources the ability to express, in writing, an interest in this acquisition. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Herman Miller is the only vendor able to provide able to provide furniture/equipment that will match the existing furniture throughout GFSC because they are the sole owner and operator Herman Miller, Incorporate of Zeeland, MI. An RFI will be publicized to acquire information on alternate sources and methods that may satisfy this requirement and the requirement will be competed at the expiration of this Order. Global Financial Services Center (GFSC) has, within applicable Department guidelines, established space and furnishing standards for all our offices. Standardization permits GFSC to more effectively estimate cost for office reconfiguration, expansion and efficiency when mission requirements dictate necessary changes. Department of State supports competing any requirements among vendors who are able to supply the same product to obtain the lowest cost.
