- NOTICE OF INTENT TO AWARD SOLE SOURCE THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c) (1), set forth in Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Reference Number is F1M3F10043A001ZPortal. The 437th Contracting Squadron, 101 E. Hill Blvd., Charleston AFB SC, requires all inclusive service and maintenance agreement for the Z-Portal Cargo and Vehicle Screening System located at Charleston AFB, South Carolina. The 437th Contracting Squadron intends to make an award to American Science and Engineering, Inc., 826 Middlesex Turnpike, BILLERICA, MA 01821. Market research was performed and information gathered in determining this company to be the only source for this requirement in the US. Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: The proposed contract action is for services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested parties may identify their interest and capability to response to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received by the appointed due date will be considered by the Government. A determination by the Government not to compete with this proposal based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The justification for the sole source requirements as follows: AS&E designed and built the Z Backscatter Portal. The A Backscatter "is one of a kind" piece of equipment designed to electronically X-Ray vehicle and cargo inspection for venicles entering the Charleston AFB which also meets the ANSI N43-17 "Radiation Safeth for Personnel Security Screening System." AS&E has also designed the software that operates the Z Backscatter Portal and has it copyrighted. If the equipment was to breakdown and they were not at our disposal, it would adversely affect the mission. Award shall be made in the aggregate all or none. AS&E is the only known source that can satisfy the Government's requirement. The Government will continue to search the market for vendors who can provide services that will fulfill the preventive maintenance and repair requirements for the Z-Portal System.
