- DEPARTMENT OF VETERANS AFFAIRS NETWORK 22 LOGISTICS OFFICEJUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-1, 41 U.S.C. 253 (c) (1) "PURCHASE OF MEDICAL EQUIPMENT SYSTEM" 1. Agency and Contracting Activity Identification: The Network 22 Logistics Office, 5901 E. 7th Street, Long Beach, California, as requested by the VA Greater Los Angeles Healthcare System (VAGLAHS), will enter into a supply contract that requires justification for other than full and open competition. 2. Nature of Acquisition Being Approved: Sole source contractor shall provide a SuperDimension medical equipment system to the VAGLAHS under the terms and conditions of a supply contract. 3. Description of Requirement: VAGLAHS is requesting a sole source service contract from SuperDimension Inc. The period of performance is February 22, 2010 through February 21, 2011. The estimated for cost for the system is $168,065.00. 4. Statutory Authority Permitting Other Than Full and Open Competition: The service is being procured under the authority of 41 U.S.C. 253 (c) (1), FAR Part 6.302-1 (c) (1). 5. The Nature of the Acquisition Requires Use of the Authority Cited: The SuperDimension medical equipment is an endoscopic system which uses electromagnetic navigation bronchoscope to allow for biopsy of peripheral lung lesions, and mediastinal nodes as well as placement of dye and radio surgical markers. It uses software which imports CT scans and creates a virtual three (3) dimensional image for case planning. During the procedure an adaptor is attached to the bronchoscope through which a guide is passed and navigated to the lesion. After the lesion is located, the guide is pulled out and tools are advanced for biopsy. The Electromagnetic Navigational Bronchoscopy system must be capable of using CT and PET scans matched to patients to guide a steerable catheter to peripheral lesions and mediastinal nodes. The catheter must relay information showing location, position and distance to designated targets. This catheter is able to accept standard bronchoscopic biopsy tools and work with current therapeutic bronchoscopes. SuperDimension Inc. is the only company with access from inside the tracheobronchial tree. Furthermore, without this equipment, it would have a negative impact on the health and welfare of the veteran patients and could lead to death. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. See item Number 5 above. A notice was transmitted to the GPE (FedBizOpps) from February 1 through February 8, 2010 and I received no responses. 7. Anticipated Cost: The anticipated cost should be fair and reasonable to the government based on the using service estimate. 8. Results of Market Survey: Market research information was also obtained through the GSA website before this procurement was posted on www.fedbizopps.gov. SuperDimension Inc. is not on the Federal Supply Schedule and is currently in the process of obtaining a contract through the National Acquisition Center. See Item Number 5 above. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None. See Item Number 6 above. 10. Any Other Interested Sources? There are no other sources that expressed in writing an interest in the service. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: The anticipated life of the Government Equipment is estimated to be twenty (20) years. The Government plans to maintain this equipment for the next twenty years to maximize usage of the system. In order to overcome barriers to competition, the Government shall research other medical equipment before the procurement of a new system. 12.
