Description
January 14, 2010 JUSTIFICATION FOR OTHER THEN FULL AND OPEN COMPETITION IN ACCORDANCE WITH FAR 13.106(b)(1) and 6.302-2(b)(1) 1. The South Texas Veterans Health Care System, Audie L. Murphy Division, intends to negotiate with GE Medical System Information Technologies Inc., 8200 W Tower Ave, Milwaukee, WI 53223-3219 for a firm fixed price Service Agreement IAW Federal Acquisition Regulation competition 41 U.S.C. 253 (c)(3) and FAR 13.106-1(b)(1). 2. The requirement is for services to replace a defective digital detector on the GE Medical System Model:Definium AMX700 Serial#1011458WK5 EE# 82434 LOCATION: H113-AMH-SA. 3. The Radiological Unit has a Bona Fide need to procure repair services for the the GE AMX700. The estimated cost for the repair service is $109,000.00. 4. In accordance with 10. U.SC. 2304(c)(3), 41 U.S.C. 253(c)(3), Federal Acquisition Regulation (FAR) 13.106-1(b)(1) and 6.302-2(b). 5. This service is required to continue the use of obtaining images of the internal structures of a patient through the use of radiography. The system has been used on multiple VA patients based on physicians' orders due to certain types of ailments. This X-Ray model is transportable and is carried to the patient's bedside to have an X-Ray of that particular area. This is a critical requirement as this item is used on the different floors and more importantly in the triage area. This item is used daily and to expedite the continued use would keep the hospital patient system flow running at its normal frequency. The vendor can provide the parts and service in a timely manner. Software and passwords used to install the necessary part is proprietary to GE Medical and can't be used or duplicated by other vendors. 6. A Combined Synopsis and Solicitation will not be posted in the Federal Business Opportunity System, under FAR authority 6.302-2, due to the bone fide need to the care of VA patients. 7. It is anticipated that the negotiated cost to the Government for this procurement will be fair and reasonable based on GE providing the same service in the commercial market. 8. Market research: there are no known contracts with the government, and the service required is specific to the manufacturer of the item as they are familiar to the model itself. Based on my market research for companies to repair GE Models AMX700, there was no one who was listed in GSA or on the internet who had the capability to repair this type of equipment. As a result of the market research it was determined that only one company could provide the required items, so in accordance with FAR Part 13.106(b) (1) procurement action was initiated. 9. Another vendor or repair service provider who may not work on this type model is not justifiable. It would be technically incapable to have an unknown vendor or service supplier source to work on this mode. It is justifiable to have the manufacture or supplier whom the item was purchased to repair the model. This would save the time for the continued use or the product and money based on the need of the required repairable service due to the serviced patients. To alter vendor and/or manufacture would disrupt if not negate patient care. GE Medical Systems Information Technologies Inc. is a large company, registered in CCR and not on debarred listings. 10. Only one responsible source is intended under authorities of FAR 6.302-2(b)(1) & (2) and 13.106(b)(1). 11.
