Description
The U.S. Nuclear Regulatory Commission (NRC) intends to negotiate a sole source contract with EASA Incorporated (EASA) for specialized software license which allows the NRC to develop customized templates for the building of analysis models and computational spreadsheets of spent fuel storage and transportation packages. The items being purchased through this posting will be procured in accordance with FAR Part 13-Simplified Acquisition Procedures. The period of performance for this software license is one year. The authority for negotiating on a sole-source basis with EASA is made under Federal Acquisition Regulation FAR 13.106-1(b)(1) which permits that contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name or industrial mobilization). The North American Industry Classification System (NAICS) Code is 511210 (Size Standard: $25 Million). This action is a pilot program and will be the first time NRC uses this software license and EASA is the sole developer and exclusive seller of this software license. This notice of intent is neither a request for proposal nor a solicitation of offers. A determination not to compete this proposed procurement based on responses to the notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. In doing so, interested sources must submit technical capabilities and any other information that demonstrates their ability to meet the NRC’s needs. Detailed capabilities must be submitted to the above address not later than 10 calendar days from the date this announcement appears in the Federal Business Opportunities. Telephonic responses and responses providing insufficient information for evaluation by the NRC will not be considered.
