- MOD PC04 (TAS::47 4543::TAS) RECOVERY: Modification Directive to Perform Additional Design/Build Scope for Design/Build of US Coast Guard Headquarters Building, St Elizabeths West Campus, Wash., DC RECOVERY: ARRA Funded Modification; Directive to Perform Additional Design/Build Scope for Design/Build of US Coast Guard Headquarters Building, St Elizabeths West Campus, Wash., DC. This notice is provided for INFORMATION PURPOSES ONLY. The U.S. General Services Administration, National Capital Region, has issued a Modification using the American Recovery and Reinvestment Act (ARRA) Funds to add funding to an existing Contract GS11P09MKC0051. The project is for the Design/Build of US Coast Guard Headquarters Building, St Elizabeths West Campus, Wash., DC. The ARRA Funded Modification PC04 to this contract is issued to obligate Contract Funding in the amount of $24,458,000. ADDITIONALLY: The U.S. General Services Administration, National Capital Region, has issued MOD PA03/Novation Agreement, dated December 18, 2009, to recognize and accept a Novation Agreement (effective December 14, 2009) submitted in accordance with FAR 42.1204 - NOVATION AGREEMENT for this GSA Contract RECOVERY: GS11P09MKC0051, Design/Build of the New U.S. Coast Guard Headquarters Building, located at the St. Elizabeths Campus, Washington, DC. EFFECTIVE IMMEDIATELY: This contract is hereby modified to recognize that CLARK DESIGN/BUILD, LLC (Transferor), a limited liability company corporation duly organized and existing under the laws of Maryland with its principal office in Bethesda, Maryland, has transferred this contract to CLARK CONSTRUCTION GROUP, LLC (Transferee), a limited liability company duly organized and existing under the laws of Maryland with its principal office in Bethesda, Maryland. The CLARK DESIGN/BUILD, LLC waives any claims and rights against the Government that it now has or may have in the future in connection with this contract. CLARK CONSTRUCTION GROUP, LLC agrees to be bound by and to perform the Contract in accordance with the conditions contained in the Contract. CLARK CONSTRUCTION GROUP, LLC also assumes all obligations and liabilities of, and all claims against the CLARK DESIGN/BUILD, LLC under the contract as if CLARK CONSTRUCTION GROUP, LLC were the original party to the contracts. This contract remains in full force and effect, except as modified by the attached Novation Agreement, as executed by CLARK DESIGN/BUILD, LLC, CLARK CONSTRUCTION GROUP, LLC and the Government of the United States of America.
