- The USCG Engineering Logistics Center has a requirement to procure the following: Item 1) NSN: 4720-01-450-4124, Tubing Assemblies P/N T-J-540A014-0 USED ON 110’ WPB Coastal patrol Boat’s Rigid Hull Inflatable boat Quantity: 3 ea. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format outlined in FAR Subpart 12.6, current through FAC 2005-35 (Aug 2009), and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Quotations are being requested and a written solicitation will not be issued. The NAICS code for this solicitation is 326299 and the Small Business Size Standard is 1,000 employees. This acquisition is being solicited on an unrestricted basis. This synopsis/solicitation is issued pursuant to FAR 6.203-1 and HSAM 3006.302-1. The resultant purchase order will be awarded using simplified acquisition procedures in accordance with FAR 13.5. It is the Government’s belief that only Zodiac of North America Inc. can provide the parts that match form, fit, and function of the original equipment parts, therefore negotiations shall be conducted only with these sources unless other sources can provide written confirmation that they are authorized distributors of the OEM or have previously supplied the identical parts under contract to the U.S. Coast Guard or U.S. Navy. Sources, other than identified herein, that are interested in responding to this notice must provide the following information: (1) Complete and current engineering data to demonstrate the acceptability of the offered parts (i.e., salient physical, functional, and performance characteristics) and/or (2) Data that the offered parts have been satisfactorily manufactured for the Government or the Original Equipment Manufacturer. This data must include sufficient information to allow the Coast Guard to evaluate the information relative to the above requirements. This information must be received within seven (7) calendar days from the date this Notice is published. Inquiries/information received after the established deadline shall NOT be considered for this acquisition. The submission of this data for review shall not impede award of this contract. The Government does NOT intend to pay for information solicited. PRESERVATION, PACKAGING, PACKING, AND MARKING All material shipped to the U.S. Coast Guard Engineering Logistics Center, Bldg. 88, Receiving Room, 2401 Hawkins Point Road, Baltimore, MD 21226 must be accompanied by an itemized packing list securely attached to the outside of the package. All packing lists shall cite the Contract Number. Material shall be packed for shipment in such a manner as to afford adequate protection to the item against corrosion, deterioration, and physical damage during shipment from the supply source to Engineering Logistics Center locations. Package shall also provide adequate protection for warehouse storage and multiple shipments. All packages shall have the purchase order number, stock number (if applicable) and vendor name and part number clearly marked on the exterior of the package. All deliveries are to be made Monday through Friday between the hours of 7:30 AM and 3:30 PM. Failure to following the packaging instructions will result in rejection of the shipment and return of the shipment to the Contractor at the Contractor’s expense. PLACE OF DELIVERY All parts shall be delivered to the USCG Engineering Logistics Center, Receiving Room, Building 88, 2401 Hawkins Point Road, Baltimore, MD 21226. INSPECTION AND ACCEPTANCE Inspection and acceptance shall take place at Destination after verification of preservation, packaging, and marking requirements and confirmation of no damage during transit. The Government intends to evaluate proposals and make award without discussions with Offerors. The Government reserves the right to seek information clarifying any element of a quotation prior to award without discussions. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. The following FAR Provisions apply to this solicitation. NOTICE FOR FILING AGENCY PROTESTS - United States Coast Guard Ombudsman Program It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accountability Office (GAO). Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman. Informal forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the USCG Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable). Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester’s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103. If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e).
