CBOC Pharmacy Emergent Refill ServicesVA263-09-RP-0261 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION as required by FAR 6.303-1 and 6.303-2 and VA Acquisitions Regulations (VAAR) 806-304. 1.AGENCY AND CONTRACTING ACTIVITY: Contracting Office is: Contracting Officer (90C), VA Medical Center, 2501 W 22nd Street, Sioux Falls, SD 57105. 2.NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED: VA Sioux Falls anticipates awarding a sole source contract to Heritage Health a Service Disabled Veteran Owned Small Business (SDVOSB). The proposed acquisition is for CBOC Pharmacy Refill Services to be provided by Heritage Health a SDVOSB. The procurement will be conducted as a sole source firm fixed priced IDIQ contract. Intend to purchase subject services in accordance with 38 U.S.C. 8127; PL 109-461 entitled "Veterans Benefits, Health Care, and Information Technology Act of 2006" and (IL) 049-07-08, Veterans First Contracting Program. 3.DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS: Contractor to fill first time prescriptions for VA patients seen at the Community Based Outpatient Clinics (CBOC) in Aberdeen, SD, Sioux City, IA, Spirit Lake, IA, Watertown, SD and Wagner, SD as well as provide medication counseling per OBRA-90 requirements, and provide prescription pads for the writing of these prescriptions, for the period of 1/1/2010 (or date of award) through 12/31/2010 with four (4) one year option periods. Prices to be offered with respect to Average Wholesale Price (AWP). 4.STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION; Intend to purchase subject services in accordance with 38 U.S.C. 8127; PL 109-461 entitled "Veterans Benefits, Health Care, and Information Technology Act of 2006" and (IL) 049-07-08, Veterans First Contracting Program. 5.DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION THAT REQUIRES USE OF AUTHORITY CITED: Heritage Health is the only known SDVSOB prescription refill service that currently has contracts with multiple pharmacies in each of our needed areas. Nature of acquisition is such that prescription refill services are needed in the following areas: SD- Watertown, Wagner, Aberdeen and IA - Spirit Lake and Sioux City. We would have to issue a multiple award contract to several vendors making payment time consuming and cumbersome. With Heritage Health we maintain one vendor who services all needed areas. 6.DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS REUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES: In accordance with IL 049-07-08 synopsis in not required in accordance with FAR 5.202(a)(4). 7.DETERMINATION BY CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT IS FAIR AND REASONABLE: Proposed costs will be evaluated against average whole sale prices as indicated in the solicitation. 8.DESCRIPTION OF MARKET SURVEY CONDUCTED (SEE PART 10) AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED: Market Research included a VetBiz search under key words of Pharmacy Service and NAICS code of 446110 revealed "No" records that match required services in all locations. As SDVOSB is listed as a VA first source for services a determination was made to issue the contract as a sole source. 9.OTHER PERTINENT FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION: In support of Veterans First contracting Heritage Health is a SDVOSB that can provide continual quality prescription refill coverage in all areas identified in the solicitation. 10.LISTING OF SOURCES THAT EXPRESSED INTEREST IN THIS ACQUISITION: Heritage Health 11.ACTIONS THE VA MAY UNDERTAKE TO REMOVE BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES: We will continue to research any alternative sources of services. 12.CONTRACTING OFFICER CERTIFICATION THE JUSTIFICATION IS ACCURATE AND COMPLETE TO THE BEST OF THE CONTRACTING OFFICER'S KNOWLEDGE AND BELIEF: I certify that this justification is accurate and complete to the best of my knowledge and belief.
