- Clause 52.212-5 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested, and a written solicitation will not be issued. The Solicitation Number is RFQ-TOTS-RFQ-10-0106, and this solicitation is issued as a Request for Quotations (RFQ) for comprehensive mortgage payment data. This solicitation document incorporates provisions and clauses in effect through Federal Acquisition Circular 2005-37. This procurement is unrestricted with the assigned North American Industry Classification System code 511210. The Contractor shall provide EMC Source 1 eDiscovery Manager Software. The software will provide an intergrated solution that will enable the identification, preservation, collection, processing, and review of email and attachment information for litigation, compliance and internal or regulatory investigations. The Contractor shall submit a quotation for the licenses to the Office of Thrift Supervision, 1700 G Street, NW, Washington, DC 20552 no later than November 10, 2009 at 12:00 p.m. local time: Line Item 0001 - EMC Source 1 eDiscovery Manager Software Licenses (1500 users) The selected Offeror must comply with the following commercial item terms and conditions. FAR 52.212-1, Instructions to Offerors - Commercial; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; and 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items (see attachment for 52.212-5 applicable clauses) apply to this acquisition. The selected Offeror must submit a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and price related factors considered. Offerors shall submit descriptive literature and technical features with offer. Price will be evaluated to determine its fairness, completeness, and reasonableness as it relates to the items offered. Shipping is FOB Destination.
