Description
DEPARTMENT OF VETERANS AFFAIRS Justification Review Document For Other Than Full and Open Competition 1. Contracting Organization: VA Black Hills, Fort Meade, SD 2. Description of Action: A Firm Fixed-Price contract is contemplated for acquisition of construction services for emergency hail storm repairs for Fort Meade VA Medical Center roofs, etc. in Sturgis, SD. Roofs experienced failure from a recent hail storm. Severe hail damage (egg to baseball size hail) was experienced and many shingled roofs, flashings, greenhouse panels, smoking shelters, windows, siding, and wood and vinyl trim received significant damage. 3. Description of Commodities: Work consists of permanent repairs for hail storm damage to misc campus buildings to protect property, infrastructure, and provide protection from weather elements. Damaged shingled roofs, greenhouse panels, flashings, smoking shelters and vinyl siding will be replaced; damaged wood trim and siding will be re-painted; damaged windows/screen will be repaired. 4. Statutory Authority: 41 U.S.C. 253 (c)(2) 5. Validity of Use of Statutory Authority: This vendor is a SDVOSB general contractor with extensive experience in all phases of construction and is thus a good match for this multi-faceted repair work. The contractor is mobilized on site completing work on another contract and has exhibited competency in completing that job. The contractor is of sufficient size and has the current crew capacity to expeditiously complete the work. The damaged shingled roofs and acrylic panel roofs (greenhouse and smoking shelters) are significantly damaged and the equipment, supplies, and infrastructure contained within is not protected.. Damaged flashings no longer providing water diversion and water damage is eminent if repairs are not completed ASAP. Damaged exterior envelope systems due to hail are contributing to pest control issues in the hospital and outlying buildings. Thus this work must be completed as soon as possible. Having roofing and building envelope systems that are compromised and not water and pest control tight constitutes an unusual and compelling urgency for the government and this repair work is critical to the mission of the hospital. Therefore, in accordance with Federal Acquisition Regulation (FAR) 6.302-2, Statutory Authority 41 U. S. C. 253 (c)(2) is being cited. 6. Sources Solicited: Ainsworth-Benning of Wyoming was the first vender contacted. They are currently mobilized on-site, have demonstrated competency in general construction, and were in a position to mobilize a crew immediately to commence repairs as soon as given approval to proceed 7. Market Research Conducted: Due to unusual and compelling urgency, a minimal Market Survey was completed. There are a limited number of firms in the Black Hills area that are qualified to perform this type of work, which are also in the socio-economic categories of SDVOSB, VOSB, or SBA 8(a). While some other firms within the region have capability to perform the type of work anticipated, it is in the Governments best interest to continue with Ainsworth-Benning of Wyoming as a sole source vendor. Ainsworth-Benning of Wyoming is a SDVO small business. 8. Other Facts Supporting the Use of Other Than Full and Open Competition: The following reasons are cited for using the selected vendor, Ainsworth-Benning of Wyoming, as a sole source vender: The type of repair work lends itself to negotiated costs and repair options as we do not have the fullest set of drawings and specifications The urgency of the repair work lends itself to a negotiated, quick turn contract, as we do not have an extended timeline for full and open competition. 10. Actions to remove Barriers to Competition: Facilities Engineering and Contracting are researching options for competition on unit pricing on certain construction tasks, thus unit prices could be established for use in emergency situations similar to this, thus facilitating quick response and also accommodating pre-determined competition. 11. Fair and Reasonable Price: Pricing for previous work performed by this contractor has been in line with Government estimates. We anticipate negotiations with this vendor to result in a fair and reasonable price, as determined by the prepared Government estimate, as well as the prevailing costs for this type of work in this area. 12. Contracting Officer's Certification: Based upon the information provided herein, I believe the justification for awarding this project to Ainsworth-Benning of Wyoming on a sole-source basis is accurate and complete to the best of my knowledge and recommend we proceed as such. ________________________________________ Contracting OfficerDate Concur ________________________________________ Warranted One Level Above CODate
