- DEPARTMENT OF VETERANS AFFAIRS Justification Review Document For Other Than Full and Open Competition 1. Contracting Organization: VA Black Hills, Fort Meade, SD 2. Description of Action: A Firm Fixed-Price contract is contemplated for acquisition of construction services for Project 568-09-114, Masonry Repairs, Bldg. 145. This work consists of repairs to exterior building facade. 3. Description of Commodities: Work consists primarily of masonry repairs, including tuck pointing and water proofing. Magnitude of the project is between $250,000 and $500,000. 4. Statutory Authority: Federal Acquisition Regulation (FAR) 6.302-5, Authorized or required by statute is being cited. Specifically, Sections 502 and 503 of Public Law (P.L.) 109-461, the Veterans Benefits, Health Care and Information Technology Act of 2006, currently implemented by Office of Acquisition and Logistics Information Letter (IL) 049-07-8, the Veterans First Contracting Program. 5. Validity of Use of Statutory Authority: The contractor, JE Hurley Construction, Inc, is a service disabled veteran owned business (SDVOSB). They have successfully completed 3 similar contracts at this medical center in the last 3 years. 6. Sources Solicited: This SDVOSB has successfully completed several similar projects at this facility and is available to perform the required work expeditiously. Therefore, no further sources were solicited and a sole source justification will be posted on Federal Business Opportunities. 7. Market Survey (FAR 7.102): In accordance with FAR Part 7, and buyers knowledge, a minimal Market Survey was accomplished. 8. Market Research Conducted: 9. Fair and Reasonable Price: Pricing for previous work performed by this contractor hasalways been in line with the Government estimates. We anticipate negotiations with this contractor to result in a fair and reasonable price, as determined by the prepared Government estimate, as well as the prevailing costs for this type of work in this area. 12.
