- THIS NOTICE IS PROVIDED FOR INFORMATION PURPOSES ONLY The purpose of this notice to announce the award of Task Order #0006 to ARGO Systems, LLC (EP-W-07-094) from the Targeted Brownfields Assessments (TBA) Contracts Request For Offer # 32 and to obligate funding in the amount of $99,653.04. The period of performance will be from September 28, 2009 though February 5, 2010. The contractor shall conduct a Phase I Brownfields Site Assessment and Report, as well as Phase II on-site reconnaissance, Sampling Analysis and Monitoring Plan, Phase II Brownfields Site Investigation, Analysis of Field Investigation Samples, Disposal of Investigation-Derived Waste, and Draft and Final Phase II Site Investigation Reports. A Phase I site assessment was conducted on the Salvation Army property but was limited to the perimeter of the building and no site assessment work has been done on the City of Wilmington property. Consequently, the contractor shall conduct a Phase I ESA which shall serve as the basis for determining the actual nature/extent of the Phase II ESA. The site is located in Wilmington, Delaware. The American Recovery and Reinvestment Act (ARRA) contains specific acquisition requirements that must be met when using appropriated funds from the Act, including the need for acquisitions to be in accordance with the FAR and, to the maximum extent practicable, awarded as fixed-price (FP) contracts using competitive procedures. However, the Office of Management and Budget's guidance allows for the use of other than FP contracts. Although the Agency's Office of Brownfields and Land Revitalization (OBLR) contracts were not awarded as FP contracts, they were awarded competitively, and each contract structure was selected to provide the contractor with the greatest incentive for efficient and economical performance, given the types of services to be performed. The existing OBLR contracts have sufficient qualified acquisition personnel to provide appropriate contract administration and oversight to monitor contract performance to mitigate the Government's risk. In order to meet the requirements of the Act in the most prudent business manner within the time constraints imposed, existing OBLR contracts are the most appropriate contractual vehicles consistent with Agency plans that promote the goals of the ARRA.
