Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation is issued as a request for proposal (RFP). The solicitation document incorporated provisions and clauses in effect through Federal Acquisition Circular 2005-36. Applicable North American Industry Classification Standard (NAICS) code is 519130, size standard of 500 Employees. The contract will be awarded using simplified acquisition procedures in accordance with FAR Part 13. The acquisition is for the purchase of Legislative Tracking System IAW with SOW at the US Department of Labor in Washington, DC. See Scope of Work below: 52.232-18 Availability of Funds (Apr 1984) Funds are not presently available for this contract.. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer. I.SCOPE OF WORK The act of publishing the article is a year-long process. WHD is soliciting for a subscription service to provide information on bills introduced by state legislators. The subscription service shall provide information needed for this article every day except federal holidays beginning at 6:30 a.m. EST. Several types of information are critical: (i) legislative reports; and (ii) regulatory and customized reports. (i) Legislative Reports The contract subscription service provides a legislative report which is comprised of a listing of bills introduced by the states in the previous 24 hours along with a summary of each piece of legislation. The legislation report listing provided by the subscription service is one that is customizable by the WHD in order to meet the search parameters established by this agency. Reports must be alphabetized by state, and district, and are based on a variety of search criteria (keywords/phrases) which were established through the efforts of WHD staff and the expertise and efforts of subscription service issue analysts. These reports continue to evolve throughout the course of the contract. The subscription service search engines search the legislative databases all 50 states plus the District of Columbia in order to extract information needed by the WHD. The subscription service conducts daily searches of each individual state database, along with the District of Columbia, while searching for all introduced and enacted legislative activity that has occurred within the past 24 hours. Even with the search parameters set at the WHD requirements, the listing and summaries are expected to reach 5,000 to 7,500 in number each year. Each legislative item and summary on the list is then reviewed and analyzed by WHD staff to determine if the item falls into one of more than thirty labor legislation categories that are tracked by this Division. Those pieces of legislation that fall within the thirty plus categories are entered by WHD staff into a separate database that will be maintained on a server controlled by the subscription service. The information (throughout the entire legislative process) must be updated daily by the Contractor for WHD review by 6:30 a.m. EST. The second legislative report provided by the subscription service, which must be made available on a daily basis to WHD, is a listing of legislation that is enacted by the states and/or the district in the previous twenty-four hours. Additionally, the subscription service must provide a summary of each piece of legislation. This information is analyzed on a daily basis by WHD staff. The report also serves as a backup/check for the first report. This secondary report is necessary because legislation may go through several iterations between first being introduced introduction and actual enactment, thus changing the information provided in the initial summary and resulting in a different determination by the WHD as a result of our further review and analysis. Upon determination that the enacted legislation is appropriate for our purposes, each piece is written up by the WHD staff and made ready for inclusion in the Monthly Labor Review publication. (ii) Regulatory and Customized Reports: The service must also provide a report each day on the fifty states and the District of Columbia, which must include the following capabilities and elements: (1) full text search and retrieval, (2) topic searching, (3) summaries and status, (4) private files (includes customized headings and attendant data, data tags, and commentary), (5) private WHD report files as developed by WHD staff, and (6) a calendar of state legislative agency sessions – both regular and special. II.PERFORMANCE REQUIREMENTS Services provided by the subscription service include and are closely related to the following: •One interface that incorporates all services – one major interface that includes all contractor services and may allow database changes; •Five (5) log user log-ins. The five user log-ins permit the downloading of reports and input of changes to the database; •Service provided by subscription service permits the WHD to efficiently monitor state and district legislative activity to review proposed and enacted laws for purposes of reporting on said enacted legislation in the DOL-BLS Monthly Labor Review publication; •Customer service available twenty-four hours a day, seven days a week for occasional special reports that may require weekend access to updated information. This information is updated seven days a week by the contractor; •Access to the National StateNet Capitol Journal, a publication that provides insight into upcoming state legislation along with information on labor issues that are of state gubernatorial and legislature interest; •Hearing calendars – proposed legislative hearings for the states and the district. III.STAFFING N/A for WHD IV.DELIVERABLES The subscription service provides a variety of services and reports to the WHD. These are: 1.Used by the WHD to efficiently monitor state and district legislative activity to review proposed and enacted laws for purposes of reporting on said enacted legislation in the DOL-BLS Monthly Labor Review publication. 2.Delivered onto the Internet and listed by state and legislative bill number; 3.Daily reports listing all introduced legislation, (author, location, and changing status by 6:30 a.m. daily); 4.Daily reports listing all enacted legislation and enactment date by 6:30 a.m. EST daily; 5.A summary of each piece of introduced legislation by 6:30 a.m. EST daily; 6.A summary of each piece of enacted legislation by 6:30 a.m. EST daily; 7.A separate file, maintained by the subscription service, of all WHD data files; •Separate file maintained by the subscription service on a state-by-state and district basis of all WHD data files. These files were originated by the WHD and are updated daily by the contractor. 8.A subscription service report listing possible upcoming legislation on “hot issues” as discussed by state legislatures and/or governor; 9.Special reports provided upon WHD request. VII.ADDITIONAL INSTRUCTIONS AND SPECIAL CONSIDERATIONS 1.Period of Performance: The duration of this Task Order will be for twelve (12) months from the date of award, approximately October 1, 2009 through September 30, 2010 unless terminated sooner by the issuance of a task closure memorandum by the Contracting Officer. 2.Identification of Possible Follow-on Work: This Task Order has a base, plus (4) option years that may be exercised each year, depending upon WHD needs and the subscription service’s successful completion of the original period of performance. 3.Place of Performance: Not Applicable 4.Travel: Not Applicable 5.Government Furnished Equipment/Items/Support: Not Applicable – WHD does not provide any equipment/items or support. Contractor provides all equipment/items and support. 6.Security: Not Applicable – Access is limited to passwords controlled by five WHD employees.
