Description
The U.S. Department of State, Office of Acquisition intends to issue a Sole Source award to Nonlethal Technologies Inc., 9419 RT 286 Hwy W, Homer City, PA 15748-9322 for (1) MPG Grenade Talc Practice T110, qty: 500; (2) MPG Grenade CS dust, qty: 500; (3) Dispenser TG 50% Talc 50% CS 55grams, qty: 500; (4) Dispenser TG 100% CS 110 grams, qty: 500; (5) C200 Cartidge Lauching for T110, qty: 4,000; and (6) Laucher Grenade for MPG, qty: 100. Nonlethal Technologies is the sole manufacturer of the MPG Grenade Line. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Recommend that the Department of State use other than full and open competition for the acquisition of the Tear Guard Systems currently in use at the U.S. Embassies and Consulates worldwide.. 2. It is required that the Tear Guard System, dispensers and launcher adapters be purchased. These items will enable the DS Agents to provide continued protection for personnel overseas. All DSS Regional Security Officers (RSO's) and their Security Engineers have been trained to reload grenades, test, and monitor the operation of these units. The dispensers requested are needed to equip the Embassy with familiar, safe, and reliably functional protective equipment. The DS/DT electronically fired, reloadable tear gas grenades and dispensers are necessary for the replacement of expired units and installing at the Embassies.. 3. The statutory authority permitting other than full and open competition is 41 USC 253(c)(1). The regulatory authority is FAR 6.302-1, only one responsible source and no other supplies or service will satisfy the agency's requirements. 4. NonLethal Technologies is the sole manufacturer of the MPG Grenade Line. NonLethal Technologies is the only company that has been licensed for the sales of TG Guard Security System and its components. 5. The economic impact to the U.S. Government for using other items than what is requested, would be great and would involve the re-training of all personnel on any new make, model, or system design.
