Description
DEPARTMENT OF VETERANS AFFAIRS Justification Review Document For Other Than Full and Open Competition 1. Contracting Organization: VA Black Hills, Fort Meade, SD 2. Description of Action: A Firm Fixed-Price contract is contemplated for acquisition of construction services for furnishing and installing a new domestic water well pump system at the Black Hills National Cemetery in Sturgis, SD. The work shall include all labor, materials, equipment and supervision necessary. 3. Description of Commodities: The Work shall include, but shall not be limited to the following 1.Contractor shall procure and install all necessary materials to provide a new domestic water well pump system in the existing water well pump building in compliance with International Building Codes (IBC), international plumbing codes, N.E.C., and local building codes. The installation shall include tie-ins to the new 2 water supply line (installed by others) serving the Public Information Center, the Administration Building, the Maintenance Buildings, and other building domestic water supply lines as shown on the project drawing. Installation includes mechanical and electrical demolition; installation of new electrical conduits, disconnects, breakers, wiring, and devices; installation of a new stainless steel submersible water pump and all controls, devices, sensors, etc. as shown and indicated on drawings and in specifications, installation of miscellaneous pipe and pipe fittings required to connect the new domestic water well pump system supply line to the new 2 building domestic water supply line and as per plans and specifications. 2. Haul away & dump debris and waste to an approved disposal site. 3.Thoroughly clean up the work area at the end of each days work, and at completion of the project. Leave premises clean and free of waste, scrap, used equipment, or other material intentionally or incidentally delivered to the site by Contractor or Contractors personnel. 4. Statutory Authority: Sections 502 and 503 of Public Law (P.L.) 109-461, the Veterans Benefits, Health Care and Information Technology Act of 2006, currently implemented by Office of Acquisition and Logistics Information Letter (IL) 049-07-8, the Veterans First Contracting Program. 5. Validity of Use of Statutory Authority: The contractor, St. Pierre, Inc., a Veteran Owned Small Business (VOSB), has been awarded a competitive construction contract for installing a domestic water line from the proposed pump location to several facility buildings at the Black Hills National Cemetery. As such, the contractor is required to tie-in with the proposed pump. It is in the Governments best interest to sole-source the pump installation project to this contractor under the aforementioned authority to minimize additional costs associated with a formal solicitation for the project, as well as timeliness and coordination between the two projects. 6. Sources Solicited: No other Service Disabled Veteran Owned Businesses (SDVOSB) or Veteran Owned Small Business (VOSB) were solicited as the current contractor is a VOSB and the most advantageous contractor to utilize for the project. 7. Market Research Conducted: None was conducted for the reason stated above. 8. Other Facts Supporting the Use of Other Than Full and Open Competition: The current contractor is a VOSB and will be performing the associated work of installing a domestic water line from the proposed pump to the near-by buildings. Use of this contractor will minimize additional costs associated with a formal solicitation for the project, as well as timeliness and coordination between the two projects. 10. Actions to remove Barriers to Competition: Fiscal appropriations were responsible for conducting this work as two separate projects. If funding had been available to award one contract for the entire project, it would have eliminated the need to sole-source this associated project. 11. Fair and Reasonable Price: A proposal was requested from the VOSB contractor awarded the water line project and submitted to the MSN III Engineering Staff for review. The staff made the determination that the proposed price, when compared to the Independent Government Estimate, was fair and reasonable. 12. Contracting Officer's Certification: Based upon the information provided herein, I believe the justification for awarding this project to St. Pierre, Inc. on a sole-source basis is accurate and complete to the best of my knowledge and recommend we proceed as such. ________________________________________ Contracting OfficerDate Concur ________________________________________ Warranted One Level Above CODate
