Description
The Department of Veterans Affairs Medical Center, 7305 N. Military Trail, West Palm Beach, FL 33410 has the need to maintain the automatic transfer switches and parallel control switchgear at the VA Medical Center. The VA Medical Center in West Palm Beach intends to make a sole source award to ASCO Services, Inc., a large business, for the maintenance of the automatic transfer switches and parallel control switchgear for one year and 3 option years, October 1, 2009 through September 30, 2013. ASCO Services constructed and designed the automatic transfer switches and parallel control switchgear and portions of the system are still under warranty. ASCO Services unique qualifications and experience are invaluable to the criticality of this service as these systems provide emergency power to the Medical center. Services, Inc. has proven to be capable of providing these services with outstanding performance ratings. This notice of intent is for information purposes only. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government. No solicitation is available at this time. ***No response to this special notice is necessary*** Questions must be submitted to Jose L. Justification for other than full and open competition West Palm Beach VA Medical Center Contracts Team Sole Source Justification Maintenance of Automatic Transfer Switches and Parallel Control Switchgear (1)Description of the supplies or services required to meet the agency's needs (including the estimated value and proposed contractor)? VA Medical Center in West Palm Beach has a need to maintain the automatic transfer switches and parallel control switchgear at the VA Medical Center. The identified vendor will be required to furnish all materials, tools, OEM parts, instruments and labor to perform Maintenance and Emergency Service on the Medical Center Automatic Transfer Switches and Paralleling Switchgear in accordance with the following Codes and Standards and Performance. 1) UL 1008 - Standard for Automatic Transfer Switches; 2) NFPA 70 - National Electric Code; 3) NFPA 99-Essential Electrical Systems for Health Care Facilities; 4) NFPA 110-Emergency and Standby Power Systems; 5) IEEE 446-IEEE Recommended Practice for Emergency and Standby Power Systems for Commercial and Industrial Applications; 6) NEMA ICS10 (formerly ICS2-447)-AC Automatic Transfer Switches; 7) NETA-International Electrical Testing Association; 8) Original equipment manufacturers recommended procedures. (2)Identify the statutory authority permitting other than full and open competition. (Check ONE only)? ___X_ FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (Use the space in #3 to list vendor's unique capabilities) _____ FAR 6.302-2 -- Unusual and Compelling Urgency (Use the space in #3 to describe the harm to the Government that will occur if award is delayed.) _____ List other FAR Part 6 Exception to Competition (3) List proposed contractor's unique qualifications or the nature of the acquisition that supports the use of the authority cited above (Proprietary rights, unique attributes or capabilities, harm to the Gov if award is delayed etc) ASCO Services designed and constructed the Automatic Transfer Switches and Parallel Control Switchgear at the West Palm Beach Medical Center and have portions of our systems still under warranty for 4 years. Their unique qualifications and experience are invaluable to the criticality of this service as these systems provide emergency power to the Medical Center. Awarding to a new contractor would void our existing warranties and could potentially harm existing services provide to the Medical Center. (4)Describe actions taken (if any) to remove or overcome any barriers to competition and to increase the possibility of competitive contracts for this effort in the future: The Government will continue to search for additional sources for this exact or comparable product in future requirements. (5)Description of the market research conducted and the results or a statement of the reason market research was not conducted. Market research revealed that ASCO Services is the only source that can offer this capability because its experience and capability with our existing system. (6)Any other facts supporting the use of other than full and open competition (Attach Continuation Sheets if more space is needed): I certify that this justification is accurate and complete to the best of my knowledge and belief.
