- (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested see written solicitation attached. (ii) W912CM-09-T-0362 Request For Quote (RFQ). Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-26. (iii) Applicable NAICS code to the below line items is 334119. ITEM NO: Quantity: Unit: Description CLIN 0001: 1: Lot: Aeronautical Message Handling System. See attached RFQ for details. CLIN 0002: 20: Each: User Account Licensing. This is an option CLIN that may be exercised upon contract award or after installation and testing of CLIN 0001. (iv) Date of Delivery: Place(s) of delivery and acceptance and FOB point: Heidelberg, Germany. COMMERCIAL ADDRESS: HQ USAREUR & 7TH ARMY, G3 AVN, ATTN: AEAGC-AV-AFOD, Heidelberg FLUGPLATZ, BLDG. 201, 69124 HEIDELBERG, GERMANY. (v) The provision at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition. Offers may be submitted by email or faxed to the designated point of contact. For additional details, see attached RFQ. (vi) Vendors must be registered and active in Contractor Central Registration (CCR) http://www.ccr.gov/. (viii) Award will be made to the responsible vendor with low priced technically acceptable quote that meets the required equipment. Award is all or none basis. Quotes shall be submitted in EURO. (ix) Offeror has to include a completed copy of the provisions at FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items, and DFARS 252.212-7000, OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JUN 2005), with its offer. (x) Clause at 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition. The following clauses will be included if award is made to a host nation vendor: 52.225-14, INCONSISTENCY BETWEEN ENGLISH VERSION AND TRANSLATION OF CONTRACT (FEB 2000); 252.229-7001, TAX RELIEF (JUNE 1997); 252.225-7042, AUTHORIZATION TO PERFORM ((APR 2003); 252.232-7008, ASSIGNMENT OF CLAIMS (OVERSEAS) (JUN 1997); 252.233-7001, CHOICE OF LAW (OVERSEAS) ((JUN 1997); and, 252.225-7041, CORRESPONDENCE IN ENGLISH (JUN 1997) (xi) Clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items June 2008)(Deviation) and DFARS 252.212-7001, CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS APPLICABLE TO DEFENSE ACQUISITIONS OF COMMERCIAL ITEMS (MAR 2008), apply to this acquisition with the following clauses included (checked): 52.203-3, Gratuities (APR 1984) (10 U.S.C. 2207) and 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports (MAR 2008) (10 U.S.C. 2227). Also, clause at 252-246-7000, Material Inspection and Receiving Report (Mar 2008). (xii) The Defense Priorities and Allocations System (DPAS) and rating do not apply to this RFQ.
