- The Government intends to solicit and negotiate with only one source, U.S. Divers Company Inc., 2340 Cousteau Ct., Vista, CA 92081-8346. The procurement will be conducted on a sole source basis in accordance with the statutory authority of the Test Program for Commercial Items, Section 4202 of the Clinger-Cohen Act of 1996 as codified at 10 USC Sec. 2304(g)(1)(B), and amended by Section 807 of the Ronald Reagan National Defense Authorization Act of 2005 under the authority of FAR 13.501(a)(1)(ii). This acquisition is for Parts for the Portable Helicopter Oxygen Delivery System (PHODS) as follow: PN 1005950, Pocket, OPC, 40 each; PN 102957, 6mm Coiled Hose Assy, 40 each; PN 102958, Hose Assy Output, 40 each; PN 102998 PHODS Steel Cylinder, 5 each; PN 102980, Cannula w/o mount, 30 each; PN 102907, Mounting clip for cannula-56P, 200 each; PN 102906 Nosepiece, Cannula Spare, 200 each; PN 102955 Dial Gauge, PHODS, Spare, 30 each; PN 102986, Intake Filter, OGSI, 15 each; PN 102971, PHODS Mask, Small Narrow, 5 each; PN 102972 PHODS Mask, Medium, Narrow, 5 each; PN 102973, PHODS Mask, Medium Wide, 5 each; PN 102974, PHODS Mask, Large Wide, 5 each; PN 103043, Elbow, 6mm, Oral Nasal, 15 each; PN 102978, Cap, Exhaust Valve, Oral Nasal, 15 each; PN 102981 Assy, Microphone, Oral Nasal, 15 each; PN 102982, Valve, Exhaust, Oral, Nasal, 10 each; PN 102983, Valve, Inhalation, PHODS Mask, 10 each; PN 102984, Kit Hardware, PHODS Mask, 10 each; PN 102950, Kit OPC Annual, 300 each; and PN 102990 Kit, PHODS Regulator Annual, 300 each. The basis for restricting competition is U.S. Divers is the sole source provider of the PHODS system and related spare parts. The PHODS has also been approved for use and issued an Operational Air Worthiness Release. The NAICS code for this procurement is 339999 and the small business size standard is 500 employees. This sole source requirement will be procured under Other Than Full and Open Competition procedures and awarded on an unrestricted basis. THIS IS NOT A REQUEST FOR COMPETITIVE OFFERS and a solicitation will not be issued; however, any firm that believes it can meet the requirements may give written notification to the Contracting Officer not later than 26 September 2009, 2:00 pm CDT. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the requirements listed. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, the Government will proceed with the sole source negotiation with Life Support International, Inc. Award will be made in accordance with FAR Part 12, Acquisition of Commercial Items.
