Description
Brand Name Justification Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below using other than full and open competition, pursuant to the authority cited herein. To the best knowledge of the VA, Dell is the sole authorized manufacturer for these services. Responses to this notice must be in writing and must be received by 12:00pm cst on September 24, 2009. Additional manufactures that can provide the service will be considered only if responding with clear and convincing evidence that the firm has been granted rights to provide the services being procured. The determination to open competition based on responses is solely with in the discretion of the Government. If a solicitation is issued, no additional synopsis will be published. Contracting Activity Department of Veterans Affairs Office of Acquisition and Materiel Management Center for Acquisition Innovation - Austin 1615 Woodward Austin, TX 78772 2. Nature of Action Being Approved: This justification and approval sets forth the facts and requests approval for the issuance of a Purchase Order (PO) for maintenance of Dell Hardware Maintenance. 3.Description of Service and Supplies: Dell hardware maintenance for the period 10/01/2009 - 09/30/2010 for the Corporate Data Center Operations (CDCO) Austin Information Technology Center (AITC). The attached list identifies the specific hardware maintenance requirements. 4. Statutory Authority: FAR 11.105(1) the particular brand name, product or feature is essential to the Government's requirements, and market research indicates other companies' similar products do not meet, or cannot be modified to meet, the agency's requirement because, substantial duplication of cost to the Government would occur that cannot be recovered through competition. 5. Rationale Supporting Use of Authority Cited Above: The CDCO AITC currently owns all hardware identified in the attached list. No other manufactures can provide maintenance services for these licenses. Dell is the only manufacture since they own all software code, proprietary license rights used for patches, fixes, telephone support, online support, upgrades, and new releases, and hardware proprietary rightes. The requirement can be competed among authorized resellers as a pass through service. Competing the requirement other than brand name would not meet the Government's needs could cause additional cost to the Government in the area of re-procurement of software, downtime for maintenance services, and training for VA subject matter experts required to use the software. This duplication of cost could not be recovered through competition of the maintenance services with other manufacturers. 6. Description of Market Research: Internet searches, research on GSA schedules, and discussions held with commercial companies and subject matter experts were held. Research indicated that no other products in the market place can be identified to meet the Governments requirements identified above. 7. Determination of Fair and Reasonable. Award will be issued as firm fixed priced off of the previously negotiated NASA SEWP IV contract. Price competition is expected from authorized resellers. 8. Other Supporting Data: N/A 9. Other Interested Sources: None 10.Future barriers to competition: VA has to solicit for only the specific brand names/models already in place on the CDCO AITC network infrastructure at this time. Future requirements developed as a result of new software procurement intend to remove barriers to competition by ensuring VA has data rights in order to maintain software internally or receive maintenance externally with knowledge of functional requirements.
