Louis Stokes ClevelandDepartment of Veterans Affairs Medical CenterVISN 10 Contracting ManagementJustification and Approval for Other than Full and Open Competition Upon the basis of the following justification, the use of other than full and open competition for the proposed contract action is hereby recommended for approval pursuant to the authority of 41 U.S.C. 253(c) (1), and FAR 6.302-1, only one responsible source. 1.Identification of Agency and Contracting Activity The Louis Stokes Cleveland VA Medical Center, 10000 Brecksville Road, Brecksville, OH 44141, VISN 10 Contracting Activity, 90C(B). 2.Nature/Description of Action This activity proposes to solicit with Impac Medical Systems, for software maintenance and support for the IMPAC system. 3.Description of Supplies/Services The proposed procurement will provide the Louis Stokes' VAMC with software maintenance and support for the IMPAC MOSAIQ software system. The maintenance and support will be provided for one base year plus four option years. IMPAC is the record and verification system for patient treatment planning used by Radiation Therapy. 4.Identification of Statutory Authority (X) 41 U.S.C. 253 (c) (1) Only One Responsible Source( ) 41 U.S.C. 253 (c) (2) Unusual and Compelling Urgency( ) 41 U.S.C. 253 (c) (3) Industrial, Mobilization, Engineering, Developmental, or Research Capability or Expert Services( ) 41 U.S.C. 253 (c) (4) International Agreement( ) 41 U.S.C. 253 (c) (5) Authorized or Required by Statute( ) 41 U.S.C. 253 (c) (6) National Security( ) 41 U.S.C. 253 (c) (7) Public Interest 5.Demonstration of Contractor's Unique Qualifications This is a continuing maintenance and support service for the existing IMPAC system in Radiation Therapy. Impac is the only vendor that manufactures the MOSAIQ software package for patient treatment record and verification database, and has proprietary data rights to the software. 6. Publicized Requirements The J&A will be posted on FBO within 14 days of the award. 7.Determination of a Fair and Reasonable Cost The contracting officer has determined the price of these items to be fair and reasonable based on previous purchases from this company. The cost of service for last year's purchase order was $38,035.00. 8.Market Survey GSA was searched, and a sources sought was posted to FBO July 14, 2009. It closed July 16, 2009, with no responses. 9.Other Supporting Data None 10. Actions taken to remove barriers to competition None 11.
