- Class Justification for Other than Full and Open Competition A Justification for Other Than Full and Open Competition has been approved for the Indian Health Service to enter into a contract with Urban Indian organizations for the provision of health care. Contract awards are made pursuant to Public Law 94-437, the Indian Health Care Improvement Act, Title V (IHCIA) codified at 25 U.S.C. §1651 et. Seq. These contracts will elevate the current health status and health care needs of Urban Indians and identify public and private health services resources available to them. This JOFOC shall cover the Title V contracts, which IHS will award non-competitively or in limited competition in Fiscal Years (FY) 2009, 2010, and 2011. Title V stipulates that to be eligible to receive contracts under this section contract recipients must meet specific qualifications. The applicant must be a non-profit body situated in an urban center. This non-profit must be governed by a board of directors that is controlled by Urban Indians and must provide for maximum participation of all interested Indian groups. This statutory requirement precludes sources that do not meet these qualifications from competing for these contracts.
