Description
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION Part I Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows: (1) Agency and Contracting Activity. The Department of Homeland Security (DHS) / Federal Emergency Management Agency (FEMA), DO-DC-TE-MA, XXXX, 65 Old Marlboro Rd, Maynard, MA 01754, Phone: XXXX, has a requirement for ten manual pan and tilt directional antenna mounts. (2) Nature and/or description of the action being approved. Recommend award to PEPRO, 671 Colbert Avenue, Oil City, PA 16301 on a sole source basis. (3) Description of Supplies/Services. Requirement is for ten manual pan and tilt directional antenna mounts - two each to be shipped to each of the five FEMA MERS Detachments. (4) Estimated value of the acquisition: $52,000.00. (5) Identification of Statutory Authority Permitting Other Than Full and Open Competition. The statutory authority permitting other than full and open competition is 10 USC 2304(c)(1) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements". Demonstration That the Nature of the Acquisition Require Use of the Authority Cited. FEMA MERS has acquired new Aluma Towers systems to be utilized for the LOS system. The towers received do not have any pan and tilt device needed. The Aluma Towers are constructed of aluminum and therefore cannot handle too large of a payload mounted on top of it. It's maximum load capacity is 125 pounds for all components mounted on top. Standard XXXX pan and tilt devices weighs ~37 pounds by itself. Coupled with FEMA's directional antenna, all mounting hardware and all required cables and coax, plus any LMR platform which may be required as well, will exceed the maximum payload the tower can handle. PEPRO's manual pan and tilt directional antenna mount weighs only 10 pounds, and can handle the payload that the standard XXXX can handle. It can safely be utilized on the Aluma Towers along with all the other components needed and not exceed the allowable payload. (6) Additional supporting facts for the acquisition: Technical data packages, statements of work or purchase descriptions suitable to maximize competition to the maximum extent practicable are not available. Currently, PEPRO's pan and tilt directional antenna mount is the only product available that weighs 10 pounds and can handle the payload required and still function safely. Similar products on the market exceed the weight limit. (7) Removal of Barriers: Not applicable. (8) The following sources expressed interest, in writing, in the acquisition. None. Part II 1. This requirement was posted on FedBizOpps on September 8, 2009 as a notice of intent to sole source to PEPRO. No capability statements were received as a result of the notice. 2. Market Research. No additional market research was conducted to determine potential sources because initial market research showed that all other standard pan and tilt antenna mounts will exceed the allowable Aluma Tower payload. 3. I have determined that the anticipated price(s) will be fair and reasonable based on comparison of similar products.
