Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.This requirement is being issued under the Simplified Acquisition Procedures as a Request for Quotation (RFQ) VA-250-09-RQ-0282. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-36, Effective on August 11, 2009. The North American Industry Classification System (NAICS) is 561790. The small business size standard is $7.0 million. This procurement is a 100% service disabled veteran owned small business set-aside (SDVOSB). NOTICE TO ALL OFFERORS A site visit will be held to allow all offerors to familiarize themselves with the site conditions. Attendance is not mandatory, however, only one visit will be held at the designated time and offerors submitting responses to this solicitation will be expected to be familiar with the area. The site visit will be held on August 27, 2009 beginning at 1:30 PM EST in the lobby of Building 408 (Colonel Harris Building) at the Dayton VA Medical Center. Those planning on attending need to pre-register via email by 4:00 PM EST on August 26, 2009. Email notice should be sent to the contracting officer, Tim Hunt, at timothy.hunt@va.gov. The quotation shall consist of the following Contract Line Item Numbers (CLIN): CLINDESCRIPTIONUNITUNIT PRICE 0001Cleaning of HVAC and associated Ductwork JB$_______________ A. Scope of Work The Department of Veterans Affairs Medical Center in Dayton, Ohio, 4100 West Third Street, Dayton, OH, 45428 has a need for a contractor to furnish all labor, supervision, materials, and equipment necessary to clean its entire designated HVAC systems. Cleaning will include the air handling units, coils, return fans, exhaust fans, supply/return/exhaust air ductwork, grilles, registers, diffusers, louvers, and dampers located in building 310. The designated HVAC units to include #1, #3, #4, #5, #6, #8 and exhaust system #14. Kick off meeting with Contracting Officer, COTR, and Contractor to be scheduled within two weeks of the date of award. B. Methods of Cleaning B. 1. Air Handling Unit - B.1.a. - All accessible internal components, such as blowers, blower housing, condensate drain pans, outside air intake, return air plenum, filter plenum, and supply plenum shall be vacuum cleaned to remove all visible surface contaminants. B1.b. - Coils (heating and cooling) shall be thoroughly cleaned by high pressure washing as needed. Before washing, contractor must verify that the drain system is operating properly. B. 2. Supply/return/exhaust air duct system - B.2.a. - Contractor shall remove all dirt, dust, grease, lint, and all other foreign deposits from all accessible interior surfaces of ducts and interior components such as turning vanes, dampers, air flow measuring devices, etc.; By vacuuming, scraping, and hand brushing by manual entry. B.2.b. - The cutting of access openings into all ducts will be accomplished by the contractor in order to make presently inaccessible interior areas, accessible for a thorough cleaning. Any such openings shall be closed with new removable doors with rubber gaskets to prevent air leakage and will remain firmly attached to the main ducts. Contractor will ensure that any existing access doors that are opened and closed seal properly to prevent any air leakage. Any insulation which might be moved, torn, or cut will be refastened with acceptable trade practices to insure against the accumulation of condensation on the duct. B.2.c. - The contractor should be familiar with methods of ceiling removal, light fixture removal, and planking walkways over some areas where ceiling support is minimal. B.2.d. - Any registers or grills, if removable or parts of same if they are removable, shall be cleaned and replaced at the same location. Any dampers and linkages which require disconnection for cleaning shall be marked, cleaned, and reset to the previously marked position. All fusible links in fire dampers shall be removed and inspected. Fire dampers will also be cleaned and operated in the open and closed position to insure they are working properly. Any and all malfunctions will be reported to the engineering service a/c unit supervisor immediately. B.3. Coils (heating/cooling/reheat) - Shall be cleaned thoroughly by pressure washing using standard practices. If located in an area or position where washing is not possible, vacuum and brush coils will be used. C. Government Property The contractor shall use clean drop cloths or other suitable covering to fully protect areas where work is being performed. Additionally, all HVAC parts removed to clean the designated HVAC system area shall be replaced upon conclusion of the contract task. All work areas will be left in a clean and sanitary condition by the contractor. Extreme care must be taken to protect all VA Equipment. D. Environmental, Safety, and Occupational Health Considerations D.1. - Proper protective signs shall also be used at all times such as "Men working above", "Danger", etc. These will be used to alert other working personnel, our customers, and guests to any hazards posed. D.2. - All city, state, and federal OSHA (I.E. fall protection, hazard communication, etc.) and EPA (I.E. spill prevention, ozone depleting substances ban, etc.) guidelines and regulations must be followed in accordance with the tasks designated in this scope of work. The Dayton VA Medical Center guidelines must also be followed; these can be made available at any time per the request of the contractor. D.3. - All contractor service equipment and materials to include solid, liquid, and hazardous waste shall be removed from the Dayton VA Medical Center premises upon completion of all awarded tasks unless specific prior approval is given by engineering beforehand. D.4. - All applicable service competency certificates (I.E. technical/trade school knowledge, 10 hour OSHA construction course, etc.) must be submitted to the VA Engineering service prior to commencement of on-site work. They can be faxed to 937-267-3943 with a coversheet referencing the contract number after award. Material Safety Data Sheets (MSDS) on all chemicals to be brought on-site in order to accomplish the assigned service tasks must be provided prior to work start. E. Supervision All work will be performed under the strict supervision of the contractor by a trained foreman or supervisor. The supervisor must be able to read blueprints regarding the tasks assigned to him/her. F. Hours of Work F.1. - Cleaning hours when work can normally be performed are from 4:30 PM to 11:30 PM. F.2. - All systems shall be back in operation and restored to their operational capacity by the end of the shift. F.3. - Arrangements shall be made five (5) work days in advance with the engineering air conditioning supervisor or his designee before starting work. This action seeks to cause the minimum interference with the normal functions of the Medical Center. Work in some areas will be required after 5:30 PM. At times, due to possible emergency situations, work will have to be stopped or delayed until further notifications are made. G. Special Conditions G.1. - The contractor must have the ability, experience, equipment, facilities, and personnel required for a prompt, satisfactory, and safe completion of this service. G.2. - The contractor shall inform the engineering service air conditioning unit of any broken, defective, non-working components of the system that they may come upon. G.3. - The Contractor will be issued keys by the COTR for entry into the areas that contain the units to be cleaned. Contractor is responsible and liable for all keys issued by the COTR and will be required to sign the keys in and out. G.4 - Contractor shall adhere to all medical center policies and procedures prior to and during the commencement of work on site. Samples of policies that are to be followed are attached to the solicitation. Offerors are advised that the following contract clauses are incorporated into this solicitation and need to be filled out and submitted with their offers where applicable. 52.252-2Clauses Incorporated by Reference (Feb 1998) This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. (Feb 2007) and the following clauses are incorporated into 52.212-4 as an addendum to this contract: 52.204-9 Personal Identity Verification of Contractor Personnel. (Sept 2007) 52.212-2Evaluation - Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Lowest price technically acceptable. Past Performance will not be used as an evaluation factor for this solicitation in accordance with FAR 15.101-2 (b) (1). Offerors submitting a response to this solicitation are certifying that they can meet all the technical requirements outlined within the Statement of Work associated with this solicitation. Technical is approximately equal to price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of Clause) 52.212-3Offeror Representations and Certifications - Commercial Items An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically at http://orca.bpn.gov. If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (c) through (m) of this provision. (a) Definitions. As used in this provision- "Emerging small business" means a small business concern whose size is no greater than 50 percent of the numerical size standard for the NAICS code designated. "Forced or indentured child labor" means all work or service- (1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or (2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties. "Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture. "Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate- (1) Are conducted under contract directly and exclusively with the regional government of southern Sudan; (2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization; (3) Consist of providing goods or services to marginalized populations of Sudan; (4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization; (5) Consist of providing goods or services that are used only to promote health or education; or (6) Have been voluntarily suspended. "Service-disabled veteran-owned small business concern"- (1) Means a small business concern- (i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and (ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran. The offeror certifies, to the best of its knowledge and belief, that the offeror and/or any of its principals- (1) o Are, o are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency; (2) o Have, o have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property; (3) o Are, o are not presently indicted for, or otherwise criminally or civilly charged by a Government entity with, commission of any of these offenses enumerated in paragraph (h)(2) of this clause; and (4) o Have, o have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied. (i) Taxes are considered delinquent if both of the following criteria apply: (A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted. (B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded. (ii) Examples. (A) The taxpayer has received a statutory notice of deficiency, under I.R.C. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights. (B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights. (C) The taxpayer has entered into an installment agreement pursuant to I.R.C. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment. (D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code). (i) Certification Regarding Knowledge of Child Labor for Listed End Products (Executive Order 13126). [The Contracting Officer must list in paragraph (i)(1) any end products being acquired under this solicitation that are included in the List of Products Requiring Contractor Certification as to Forced or Indentured Child Labor, unless excluded at 22.1503(b).] (1) Listed end products. The offeror certifies that it has made a good faith effort to determine whether forced or indentured child labor was used to mine, produce, or manufacture any such end product furnished under this contract. On the basis of those efforts, the offeror certifies that it is not aware of any such use of child labor. (j) Place of manufacture. (Does not apply unless the solicitation is predominantly for the acquisition of manufactured end products.) For statistical purposes only, the offeror shall indicate whether the place of manufacture of the end products it expects to provide in response to this solicitation is predominantly- (1) o In the United States (Check this box if the total anticipated price of offered end products manufactured in the United States exceeds the total anticipated price of offered end products manufactured outside the United States); or (2) o Outside the United States. (k) Certificates regarding exemptions from the application of the Service Contract Act. (Certification by the offeror as to its compliance with respect to the contract also constitutes its certification as to compliance by its subcontractor if it subcontracts out the exempt services.) [The contracting officer is to check a box to indicate if paragraph (k)(1) or (k)(2) applies.] [ ] (1) Maintenance, calibration, or repair of certain equipment as described in FAR 22.1003-4(c)(1). The offeror o does o does not certify that- (i) The items of equipment to be serviced under this contract are used regularly for other than Governmental purposes and are sold or traded by the offeror (or subcontractor in the case of an exempt subcontract) in substantial quantities to the general public in the course of normal business operations; (ii) The services will be furnished at prices which are, or are based on, established catalog or market prices (see FAR 22.1003-4(c)(2)(ii)) for the maintenance, calibration, or repair of such equipment; and (iii) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract will be the same as that used for these employees and equivalent employees servicing the same equipment of commercial customers. [ ] (2) Certain services as described in FAR 22.1003-4(d)(1). The offeror o does o does not certify that- (i) The services under the contract are offered and sold regularly to non-Governmental customers, and are provided by the offeror (or subcontractor in the case of an exempt subcontract) to the general public in substantial quantities in the course of normal business operations; (ii) The contract services will be furnished at prices that are, or are based on, established catalog or market prices (see FAR 22.1003-4(d)(2)(iii)); (iii) Each service employee who will perform the services under the contract will spend only a small portion of his or her time (a monthly average of less than 20 percent of the available hours on an annualized basis, or less than 20 percent of available hours during the contract period if the contract period is less than a month) servicing the Government contract; and (iv) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract is the same as that used for these employees and equivalent employees servicing commercial customers. (3) If paragraph (k)(1) or (k)(2) of this clause applies- (i) If the offeror does not certify to the conditions in paragraph (k)(1) or (k)(2) and the Contracting Officer did not attach a Service Contract Act wage determination to the solicitation, the offeror shall notify the Contracting Officer as soon as possible; and (ii) The Contracting Officer may not make an award to the offeror if the offeror fails to execute the certification in paragraph (k)(1) or (k)(2) of this clause or to contact the Contracting Officer as required in paragraph (k)(3)(i) of this clause. (l) Taxpayer Identification Number (TIN) (26 U.S.C. 6109, 31 U.S.C. 7701). (Not applicable if the offeror is required to provide this information to a central contractor registration database to be eligible for award.) (1) All offerors must submit the information required in paragraphs (l)(3) through (l)(5) of this provision to comply with debt collection requirements of 31 U.S.C. 7701(c) and 3325(d), reporting requirements of 26 U.S.C. 6041, 6041A, and 6050M, and implementing regulations issued by the Internal Revenue Service (IRS). (2) The TIN may be used by the Government to collect and report on any delinquent amounts arising out of the offeror's relationship with the Government (31 U.S.C. 7701(c)(3)). If the resulting contract is subject to the payment reporting requirements described in FAR 4.904, the TIN provided hereunder may be matched with IRS records to verify the accuracy of the offeror's TIN. (n) Prohibition on Contracting with Inverted Domestic Corporations. (1) Relation to Internal Revenue Code. A foreign entity that is treated as an inverted domestic corporation for purposes of the Internal Revenue Code at 26 U.S.C. 7874 (or would be except that the inversion transactions were completed on or before March 4, 2003), is also an inverted domestic corporation for purposes of 6 U.S.C. 395 and for this solicitation provision (see FAR 9.108). (2) Representation. By submission of its offer, the offeror represents that it is not an inverted domestic corporation and is not a subsidiary of one. (End of provision) 52.212-5Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items. (End of clause) VA NOTICE OF TOTAL SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS SET-ASIDE (a) Definition. In accordance with 38 U.S.C. 8127, for the Department of Veterans Affairs, "Service-disabled veteran-owned small business concern"- (1) Means a small business concern- (i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans (or eligible surviving spouses) (38 U.S.C. 8127(h) and (k)(2)(A)(i)); and (ii) The management and daily business operations of which are controlled by one or more service-disabled veteran (or eligible surviving spouse) or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran (38 U.S.C. 8127(h) and (k)(2)(A)(ii)); and (iii) The business meets federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document (38 U.S.C. 8127(k)(1)); and (iv) The business is listed in the VetBiz.gov Vendor Information Pages, (http://www.VetBiz.gov). (2) "Service-disabled veteran" means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16). (3) "Surviving Spouse" is an individual as defined in 38 U.S.C. 101(3). (b) General. (1) Offers are solicited only from service-disabled veteran-owned small business concerns. Offers received from concerns that are not service-disabled veteran-owned small business concerns shall not be considered. (e) Any service-disabled veteran-owned small business concern (nonmanufacturer) must meet the requirements in 19.102(f) of the Federal Acquisition Regulation to receive a benefit under this program.
