- U.S Customs and Border Protection (CBP) intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Tucson Iron and Metals of Tucson, AZ for upgrade of its existing incinerator facility in El Paso, TX. Tucson Iron and Metals operates the only licensed incinerator for the destruction of hard narcotics within the El Paso, TX geographic area. ***Sole Source determination is based upon the need for the Tucson Iron and Metals to upgrade and maintain compatibility with the existing incinerator. ***The North American Industry Classification System (NAICS) code for this acquisition is 423930. **The Government intends to solicit and negotiate directly with Tucson Iron and Metals. No solicitation package will be issued. This notice of intent is not a request for competitive proposals. However, if any interested party believes it can meet the above requirement, it may submit a statement of capabilities. The statement of capabilities must be submitted in writing and must contain material in sufficient detail to allow the Government to determine if the party can perform the requirement. A determination to compete this action based on the responses received is in the sole discretion of the Government. All interested parties must express their interest and capabilities in writing via email. Documents over 10 pages total will not be accepted. No faxed documents will be accepted. Verifications of receipt of responses are the sole responsibility of the contractor. If no responsive statements are received by 22 September 2009, 12:00 NOON EST, an award will be made to Tucson Iron and Metals. The Government anticipates award on or before 30 September 2009.
