- The Mobile District, Army Corps of Engineers intends to award a sole source (brand name) firm fixed price commercial contract to AVO Multi-Amp Corporation, DBA Megger, under the authority of 10 U.S.C. 2304(c) (1). This procurement is being conducted under Simplified Acquisition Procedures (SAP)-only one responsible source and no other supplies or services will satisfy agency requirements. AVO Multi-Amp Corporation, DBA Megger is the only known source capable of meeting the Governments requirements due to the unique capability to provide support and service for the Pulsar Test Set phase out and replacement with a Megger Protective Relay Test System, compatible with existing AVTS Software. The Government intends to acquire a commercial item using FAR Part 12. Interested organizations may submit their capabilities and qualifications to perform the effort in writing to the identified point of contact not later than 2:00 CST on 17 September 2009. Such capabilities/qualifications will be evaluated solely for determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice. No RFQ will be issued based upon this Notice of Intent. Interested parties may submit any information for consideration by the Government to Jacquelyn.d.mcduffie@usace.army.mil with solicitation number W91278-09-T-0089 referenced in the subject line.
