Description
PWS Solicitation THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c) (1), set forth in Federal Acquisition Regulation 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." The 99th Ground Combat Training Squadron at Creech AFB, NV, requires the purchase of an agreement to provide for updates and the maintenance and support for their Warrior Skills Trainer (WST) combat simulator. The 99th Contracting Squadron intends to make an award to Cubic Simulation Systems of 2001 W Oak Ridge Road, Orlando, FL 32809. Interested parties may e-mail stephen.colton@nellis.af.mil or fax 702-652-5405, Attn: Stephen Colton, not later than Thursday, 24 September 2009; 4:00 p.m. Pacific Time. Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: 22. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within ten days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. V. DEMONSTRATION THAT THE CONTRACTORS UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) Cubic Simulator Systems is the original equipment manufacturer of the Warrior Skills Trainer and is the only source with the expertise to support the system. The proprietary software that was developed at vendor expense is patented. The Air Force's Air Combat Command previously researched several different types of combat simulation training systems. Cubic Simulation System's simulator was the one chosen solely for Creech AFB because it was the only one to meet all the requirements of the 99 GCTS. Replacing the existing system would negate the approximate $3.6 million that ACC has already spent to purchase, install and train its personnel on the use of the existing system. In summary, to procure software maintenance and support from any company, other than Cubic Simulation Systems would result in a substantial duplication of costs not expected to be recovered through full and open competition. Failure to maintain the simulator at its operational capability would cause the critical ground force combat training program which trains a minimum of 1,500 troops annually to fail or be significantly delayed until a replacement system could be procured, installed, and tested.
