Description
DENTAL SERVICES AGREEMENT Dentist and Dental Hygienist The undersigned Center Dentist agrees to provide students of the Muhlenberg Career Development Center with the services stated herein. Such services will be provided as authorized by the Center Director or his/her representative, who will provide a schedule of hours and days to be worked weekly. The services will be provided at the Muhlenberg Career Development Center dental suite. Dentist Services will be provided for sixteen (16) hours per week. The Dentist will also provide the services of a Dental Hygienist for sixteen (16) hours per week. Remunerations for services rendered will be at the rate of $ _ per hour for the Dentist and $ _ per hour for the Dental Hygienist. The period of performance for this subcontract is from 10-1-09 through 9-31-11 with the option to extend for three one year periods. The exercise of any option year is contingent on the Government's award of an option year to Horizons Youth Services and subject to the availability of continued funding. Section A The Muhlenberg Career Development Center and the Center Dentist hereby agrees that the dental services to be provided students will be of the type and according to the priority system specified in the Job Corps Federal Regulations (Title 20, Code of Federal Regulations, 684) and ET Handbook 330 -Job Corps Health Program Guide, Technical Supplements A. These include the provision of the following: 1. Preventative dental health education; e.g., tooth brushing instruction, which will promote good oral hygiene techniques. 2. Twenty-four hour emergency coverage 3. A routine dental examination using adequate lighting, a mouth mirror and explorer, and bite wing x -ray or panorex (Type 2 classification of the American Dental Association) between the 45th and 75th day after the student's arrival on center. 4. Priority classification based on urgency of need for dental care using the Job Corps Priority Classification system. 5. A diagnosis and treatment plan for each student within two weeks after completion of the routine dental examination. On the basis of diagnoses and within program constraints, priorities for the receipt of comprehensive dental care will be established. 6. Assisting the Center Director to secure appropriate referrals to insure the receipt of special care as defined by the 330, Technical Supplement A. Section B The Center Dentist further agrees to provide services which may aid in the development, implementation, and monitoring of the total center dental health program, to include but not be limited to: I. Advice to the Center Director, Center Physician, and Center Health Staff in all dental related matters. This shall include staffing requirements, the advisability of student terminations for dental reasons, the cost of special services, and other areas deemed appropriate. 2. Assistance in developing the coordination and integration of the dental health program with other health components and other Center activity. 3. Ensurance of the maintenance, safeguarding, and confidentiality of all required dental records. 4. Advice and assistance to health education instructors in the development and implementation of the dental education component of the Health Education Program (ET Handbook 330-C) 5. Advice to the Center Director on the Center dental budget including the identification and utilization of the most appropriate and least expensive sources for obtaining necessary dental supplies and medications. 6. Issuance and maintenance of signed and dated standing orders for dental care in accordance with ETH 330, Technical Supplement Q. Section C The Center Dentist agrees to adhere to the policies, procedures and guidelines established by the Job Corps. The professional will have primary responsibility to implement the program outlined above and may be assisted by the Job Corps national health staff and/or health consultants. The Center Dentist with the concurrence of the Center Director, may delegate any of his/her responsibilities set forth in this contract to appropriate qualified staff, within the constraints defined in the State Dental Practice Act. This subcontract is subject to approval by the U.S. Department of Labor, Job Corps Contracting Officer. It is understood that the dental services provided by the Center Dentist are subject to monitoring and review by the Job Corps. Under this agreement, the Center Dentist is an independent contractor and not an employee or agent of the contractor or the Department of Labor, Job Corps. The Center Dentist agrees to provide malpractice insurance to cover the dentist's professional services to students. The Center Dentist agrees to indemnify and save, the Center harmless from any expenses including attorney's fees and also claims on account of damage to property or bodily injury (including death) which may be sustained by himself/herself or his/her employees in connections with any work performed. This agreement may be terminated, with respect to the remaining term of the agreement, at any given time by either party upon a written notice thereof to the other, effective 30 days after acknowledged receipt of said notice. The Center Dentist and Dental Hygienist agree to make no public statements concerning Job Corps students or Job Corps activities without prior written approval of the Center Director or his designated representative. All research projects and/or publications relating to Job Corps mental health activities will be cleared though the Job Corps National Staff, Washington, D.C. This agreement contains the entire agreement between the parties. It may not be modified or added to except by a written instrument signed by both parties. The maximum amount allocated to this subcontract for the period 10-1-09 through 9-31-11 is $ _ and said amount shall not be exceeded without review of the work performed and a mutually agreeable modification to the subcontract. This subcontract is subject to approval by the U.S. Department of Labor, Job Corps Contracting Officer. Remuneration for services will cover only the actual hours worked.
