- This proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement. This notice is not a request for competitive proposals; however, all information received within fourteen days after publication of this notice will be considered by the Government. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. The proposed acquisition is required for completion of a permitting action. Solicitation W91278-09-R-0061 for the Design-Build of FY-09 PN 57620, Powertrain Transmission Addition Facility, Anniston Army Depot (ANAD), AL (Calhoun County) facility requires the relocation of a creek to allow for proper siting of the building on existing U.S. Government property. Section 404 of the Clean Water Act (CWA) establishes a program to regulate the discharge of dredged or fill material into waters of the United States, including wetlands. Section 404 requires that a permit be issued before dredged or fill material may be discharged into waters of the United States. A Section 404 permit is required for this relocation. The US Army Corps of Engineers, Regulatory Division, in conjunction with the Alabama Department of Environmental Management (ADEM) has jointly approved the permit subject to the purchase of creek mitigation credits from the Westervelt Ecological Services mitigation bank. Specifically, the US Army Corps of Engineers, Regulatory Division and ADEM are requiring the use of the Westervelt Ecological Services Yellowleaf Mitigation Bank because the bank lies in the drainage basin of the effected creek. Federal environmental regulations require the mitigation effort to be in the same drainage basin where possible. The Government will not pay for any material provided in response to this synopsis nor return the data provided. The results of this synopsis will be considered to be in effect for a period of one year from the date of publication of this notice. Responses must be received fourteen (14) days after publication of this notice.
