Description
USDA, ARS, SAA intends to solicit and negotiate with only one source, Carrier Corporation, 9401-N Southern Pine Blvd., Charlotte, NC 28273 for a 19XR chiller bearing inspection and replacement on the one Carrier 19XR Chiller. Carrier designed and installed our chiller system. They have the extensive knowledge of where the cables, and electrical components, are located and specific equipment to diagnostic any malfunction during the inspection and bearing replacement of the system components. Company has proprietary rights to system software and installed modular control units. Reinitiating a new source contract would be cost prohibitive and would require additional licensing. The chiller system has service warranties solely with Carrier for maintenance conducted and any other change to this system by other contractors will void the service contract warranties. Pursuant to 6.302-1(C)(ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in (A) substantial duplication of cost to the Government that is not expected to be recovered through competition. Interested parties should submit written responses including prices and technical data sufficient to determine capability to meet the entire requirement and must be received in this office by Sept 21, 2009 at 2:00 p.m. It should be noted that no contract will be awarded on the basis of offers received in response to this notice, but will be used to determine if a comparable source more advantageous to the Government is available. If no affirmative written responses are received, negotiations will be held with Carrier Corporation without further notice. This acquisition is being conducted under the Federal Acquisition Streamlining Act, Simplified Acquisition Procedures. The anticipated award date is Sept 23, 2009.
