Description
The Government intends to solicit and negotiate with only one source, Tel-Instrument Electronics Corp., 728 Garden Street, Carlstadt, NJ 07072. The procurement will be conducted on a sole source basis in accordance with the statutory authority of the Test Program for Commercial Items, Section 4202 of the Clinger-Cohen Act of 1996 as codified at 10 USC Sec. 2304(g)(1)(B), and amended by Section 807 of the Ronald Reagan National Defense Authorization Act of 2005 under the authority of FAR 13.501(a)(1)(ii). This acquisition is for the calibration and software upgrade of thirteen (13) T-47NH Transponder/IFF/TACAN/DME/TCAS Test Sets (PN 90-000-062) and five T-36M NAV/COM Test Sets (PN 90-000-058). In addition to Calibration and Software Upgrade, New Switch Dust Boots, and New Batteries will be installed. The basis for restricting competition is Tel-Instruments is the manufacturer of the T-47NH and T-36M test sets and is the only facility authorized to do the calibrations and upgrades. The NAICS code for this procurement is 334515 and the small business size standard is 500 employees. This sole source requirement will be procured under Other Than Full and Open Competition procedures and awarded on an unrestricted basis. THIS IS NOT A REQUEST FOR COMPETITIVE OFFERS and a solicitation will not be issued; however, any firm that believes it can meet the requirements may give written notification to the Contracting Officer not later than 18 September 2009, 2:00 pm CDT. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the requirements listed. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, the Government will proceed with the sole source negotiation with Ultrax, Inc. Award will be made in accordance with FAR Part 12, Acquisition of Commercial Items.
