Department of MemorandumVeterans Affairs Date: September 9, 2009 From:GLEN WELCH, VISN 15 Contracting Officer Subj:Justification and Approval for Other Than Full and Open Competition IAW FAR 6.302-1 To:Contract File 1.IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY: Department of Veterans Affairs, VA Heartland Network 15 (Eastern) 4101 S. 4th Street Traffic Way, Leavenworth KS 66048 2.IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED: This action is based on a requirement for the upgrade and expansion of the ScImage Echo Vascular Reporting System at the St. Louis VAMC. This solicitation is being procured in accordance with the Federal Acquisition Regulation (FAR). It is being sole sourced to ScImage, in accordance with FAR 6.302-1. 3.DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED: The requirement is for the upgrade components needed for the ScImage PAC system currently being used. This upgrade will create a more functional reporting system that will interface with the current equipment as well as the VAMC's Clinical Patient Record System, CPRS. The estimated value of this contract is $274,480.64 based on the IGE from the program office. 4.IDENTIFICATION OF STATUTORY AUTHORITY: The requirement will be solicited under citation 10 U.S.C 2304 (c) (1), 41 U.S.C 253 (c) (1), FAR 6.302-1: Only one responsible source exists and no other supplies or services will satisfy agency requirements. 5.DEMONSTRATION THAT THE ACQUISITION REQUIRES USE OF AUTHORITY CITED: In accordance with FAR 6.302-1(a) these services are unique to this vendor as the majority of the hardware and software are required to accomplish this upgrades. The components used for this upgrade are custom manufactured by ScImage and are considered proprietary hardware and software.It is our professional and technical opinion that only ScImage can upgrade this system to meet the unique specifications. 6.DESCRIPTION OF EFFORTS MADE TO ENSURE OFFERS ARE SOLICITED FROM AS MANY SOURCES AS IS PRACTICABLE: Considerable market research was done on GSA and VA advantage as well as open source research to identify other vendors or products that would meet the customer's needs. Per the market research documentation contained within the contract file, no other vendor can provide the unique characteristics for this upgraded. 7.DEMONSTRATION THAT THE ANTICIPATED COST WILL BE FAIR AND REASONABLE: The price quote provided by the contractor will be compared with any previous pricing and other similar maintenance and upgrade efforts to determine that the price is fair and reasonable. 8.DESCRIPTION OF MARKET RESEARCH Market research was done to identify other vendors that would meet the customer's needs. Per the market research documentation memo also contained within this contracting file, no other vendor(s) were able to meet these unique characteristics. 9.ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION. This vendor is the only vendor with access to both proprietary hardware and software expertise to perform full and complete service and upgrades to ScImage PACs system currently on station. 10.LIST OF SOURCES THAT EXPRESSED IN WRITING AN INTEREST IN THE ACQUISITION. N/A 11.STATEMENT OF ACTIONS AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION. The Agency will continue to evaluate the marketplace to determine if other vendors have become qualified or capable of performing this type of service on unique and complex medical equipment. 12.CONTRACTING OFFICER'S CERTIFICATION: "I certify that the facts and representations under my cognizance and which are included in this Justification and Approval are accurate and complete to the best of my knowledge and belief." _____________________________Glen F.
