Description
FINDINGS AND DETERMINATION RELATIVE TO USE OF A LABOR HOUR CONTRACT (IAW FAR 16.601(c)) FINDINGS: The Centers for Disease Control & Prevention (CDC) and the Agency for Toxic Substances and Disease Registry (ATSDR), have a requirement for Management Consultants and Technical Assistance from the MASO Office. A. Because the nature of the work for management consultants and technical assistance involves varied labor categories and support, it is not possible to project with certainty how long it will take to perform the required services and associated tasks. For this reason a fixed price contract is not a suitable contract type. The work is also not susceptible to a cost reimbursement contract for the same reason - the extent of support is not sufficiently definable to allow negotiation of an estimated cost and associated fixed fee. B. With respect to the Government surveillance for labor efficiency, CDC and ATSDR technical personnel are sufficiently familiar with the work to be able to judge how much time will be required for the various services and associated tasks. Also, the types of services required are of an on-going nature, where labor efficiency is of lesser importance than where the labor is geared toward delivery of an end product. There are no materials to be supplied by the contractor, and therefore effective cost control in the purchase of materials is not an issue in this procurement. C. Although there are no materials being supplied by the contract, reimbursement of other direct costs for items such as travel or employee training may be authorized from time to time. I HEREBY DETERMINE THAT: On the basis of the above finding of facts, no other contract type except the fixed price, labor hour contract is suitable for the acquisition of services as described above. ______/S/_________ Sandra D.
