- (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. As prescribed in FAR subpart 11.107 (a), brand name or equal purchase description is included for the aforementioned requirement in this combined synopsis/solicitation. Offerors are allowed to include brand name or equal products to meet the U.S. Government requirements. (ii) W912CM-09-T-3412 Request For Quote (RFQ) is issued as an unrestricted procurement. (iii) This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. Also, the full text of a clause may be accessed electronically at this/these address (es): http://farsite.hill.af.mil/VFFARA.HTM or http://acquisition.gov/far/. See attached USACCE clauses. (iv) Applicable NAICS code to the below line items is 333924. (v) Contract Line Item Numbers (CLINS): 0001: Crown FC 4515-2.5 or equivalent Electric Forklift 1 each FFP. FOB-Destination (vi) Crown FC 4515-2.5 or equivalent Electric Forklift in accordance with attached specifications. (vii) Date of Delivery: Preferred delivery is 60 days after date of purchase order. Delivery to: USAG Grafenwoehr, Property Book Office, Lager Geb. 301, 92655 Grafenwoehr, Germany (viii) The provision at 52.212-1, Instructions to Offerors -- Commercial, applies to this acquisition. Offers may be submitted by email or faxed to the designated point of contact. (1) Technical Description. Offerors shall submit detailed technical descriptions and illustrations with their offer of the proposed equipment. The technical description shall contain a thorough explanation of the capabilities of the proposed equipment. The technical description shall include the make, model and technical specifications for the proposed equipment. Offerors are encouraged to include any technical brochures relevant to the offered items. (2) Price. The Offerors prices shall be complete and reasonably priced. The Offeror shall specify the currency used in the offer. Vendors must be registered and active in Contractor Central Registration (CCR) http://www.ccr.gov/. (ix) The provision at 52.212-2, Evaluation Commercial Items is applicable to this acquisition. Award will be made to the responsible vendor with lowest priced technically acceptable (LPTA) quote that meets the minimum requirements listed in vi above in accordance with the attached specifications. The following factors shall be used to evaluate offers: (1) Technical. Technical acceptability will be determined from the information submitted by the offeror. The information provided must thoroughly demonstrate that the items offered meet the specifications set forth in the solicitation. Offers not meeting the specifications will be determined to be unacceptable and will not be considered for award. In order to be determined acceptable, offers must meet the minimum standards set forth in the specifications of the solicitation. (2) Price. Prices will be evaluated by a comparison of the pricing of all the acceptable offers. Award will be made to the lowest priced of those acceptable offers. Award is on an all or none basis. FAR 52.225-17, Evaluation of Foreign Currency (The applicable exchange rate will be obtained from the published rate by the US Federal Reserve Bank on the following website: http://www.federalreserve.gov/releases/h10/Current/ ); CCE 233-4000, Independent Protest Review Official; CCE 233-4002 AMC Level Protest Program also apply to this RFQ. (x) Offeror has to include a completed copy of the provisions at FAR 52.212-3 Alt. I, Offeror Representations and Certifications -- Commercial Items with its offer. (xi) Clause at 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition. Addendum to 52.212-4: (1) Funds are not presently available for this acquisition. No contract award will be made until appropriated funds are made available. (2) Note to U.S. vendors: Request for payments must be submitted electronically via the internet through the Wide Area Work Flow - Receipt and Acceptance (WAWF-RA) system at https://wawf.eb.mil. The following clauses will be are included: 52.225-14, Inconsistency Between English Version And Translation Of Contract; 252.204-7004 Alt A, Central Contractor Registration (52.204-7) Alternate A; 252.225-7041, Correspondence in English; 252.229-7000, Invoices Exclusive of Taxes or Duties; 252.229-7001 Alt I, Tax Relief - Alternate I; 252.232-7008, Assignment of Claims (Overseas); 252.232-7010, Levies on Contract Payments; 252.233-7001, Choice of Law (Overseas). (xii) Clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items. (xiii) Commercial warranty is required. (xiv) The Defense Priorities and Allocations System (DPAS) and rating do not apply to this RFQ. (xv) Quotes must be submitted not later than 11:00 AM, 23 SEP 2009, CET.
