- Far Clause(s) 52.212-4 and 52.212-5 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 05-36. This solicitation is being issued as a Request for Quotation (RFQ) #269649. This solicitation is being issued under Simplified Acquisition Procedures (SAP) authorized by Test Program. The North American Industry Classification System (NAICS) is 423710 and is set aside for small business with a size standard of 500 employees. This will be a Fixed Price Contract. The Government intends to purchase on a brand name or equivalent basis 50 each of the Von Duprin Fire Exit Hardware Devices, Part Number 9975TP-F-3'-313AN. The prospective offeror must be able to offer the brand name or equivalent product to meet the minimum salient characteristics: 99-series of lock, 75-mortise lock, TP-thumb piece, F-fire rated, 3'door size, 313AN-finish dark brown, chocolate. Delivery is expected 15-30 days after receipt of order. Destination Point: Quantico, VA. Interested persons may identify their interest and capability to respond to this requirement or submit proposals for competitive bids within seven (7) calendar days after date of publication of this notice. All bids shall be submitted to the e-mail address: mischele.quarles@ic.fbi.gov no later than 12:00 p.m., EST, Friday, September 4, 2009, and be clearly posted with RFQ #269649 in the subject line of the e-mail. Bidders are hereby notified that if your bid is not received by the date/time and at the location specified in this announcement, it will be considered late. This solicitation incorporates one or more clauses by reference with the same force and effect as if they were given full text. The full text of a clause may be accessed electronically on the Internet address: www.arnet.gov with the exception of the Justice Acquisition Clause of 2852.211-70 Brand Name or Equal (Jan 1985) may be accessed electronically on the Internet address: www.usdoj.gov.Each offeror shall include a completed copy of the FAR provisions at 52.212-1 Instructions To Offerors-Commercial Items (June 2008), 52.212.3 Offeror Representation and Certifications - Commercial Items (Aug 2009), 52.212-4 Contract Terms and Conditions - Commercial Items (Mar 2009) and 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (Aug 2009) is incorporated by reference and applies to this acquisition, 52.223-1 (Dec 2007) Biobased Product Certification, and 52.212-2 Evaluation - Commercial Items (Jan 1999). An award will be made on the basis of the lowest evaluated price offer to meet or exceed the salient characteristic of this requirement. The evaluation factors are listed in descending order of importance: Technical, Warranty and Price. Technical acceptability will be determined solely on the content and merit of the information submitted by the offeror in response to this notice.
