- Attachment 1 The EPA intends to negotiate with Waters Corporation for a Service Plan for the equipment listed in the attached on a sole source basis. Based on market research, the EPA has determined that Waters Corporation is the only vendor capable of satisfying this requirement because Waters Corporation is the manufacturer of the instrumentation. In addition, the software is proprietary in nature; Waters is the sole source for support new version upgrades, and licensing of MassLynx software, and; Waters is the copyright and license holder, manufacturer and owner of the software. No other source has been identified as being able to service the equipment. A notice of intent to sole source was posted on August 18, 2009 and no responses were received.
