Description
August 21, 2008 JUSTIFICATION FOR OTHER THEN FULL AND OPEN COMPETITION IN ACCORDANCE WITH FAR 13.106(b)(1) and 6.302-2(b)(2) 1. The South Texas Veterans Health Care System, Audie L. Murphy Division, intends to negotiate with Stereology Resource Center, 104 Ringneck Court, Chester, MD 21619 for a firm fixed price Purchase Order IAW Federal Acquisition Regulation competition 41 U.S.C. 253 (c)(3) and FAR 13.106-1(b)(1). 2. The requirement is for the purchase of Stereology software and computer system for current research for the Barshop Institute for Longevity and Aging Studies. 3. ACOS for Research has a request to procure Stereology software for Windows XP and pc computer and equipment. Estimated cost for this procurement is $36,690.00 4. In accordance with 10. U.SC. 2304(c)(2), 41 U.S.C. 253(c)(2), Federal Acquisition Regulation (FAR) 13.106-1(b)(1) and 6.302-2(b). 5. These items are used in conjunction with on going Research. A computerized stereology system is required for measuring neuron loss and amyloid plaque burden in Dr. Ran's laboratory. The Stereologer system uniquely satisfies our needs because: The Stereologer is a leading system in the field because of its innovation, user friendly design, and solid technical support; The Stereology Resource Center will be able to customize the Stereologer system so it will integrate nicely with the existing imaging system in Dr. Ran' lab. To alter vendor and/or formulations would totally disrupt if not negate 18 years of research. This vendor can deliver these items in a timely manner. 6. A Combined Synopsis and Solicitation will not be posted in the Federal Business Opportunity System (BOS), under FAR authority 6.302-2, due to for measuring neuron loss and amyloid plaque burden. 7. It is anticipated that the negotiated cost to the Government for this procurement will be fair and reasonable. 8. Market research: there are no known contracts with the government, and the sales of these services are sold competitively in the commercial marketplace. I researched the internet and found FBO listing for the same type of product. I looked at the interested vendors tab and no vendors were listed. I also contacted two contracting specialist with the solicitation issued on FBO and they stated that they had not found any vendors. As a result of the market research it was determined that only one company could provide the required items, so in accordance with FAR Part 13.106(b)(1) procurement action was initiated. 9. Time is of importance due to the on-going research project. If a different software was used it would take extended time to retrain the professional and specialist staff. To alter vendor and/or formulations would totally disrupt the integration software for research. Stereology Research Center is a, registered in CCR and not on debarred listings. 10. Only one responsible source is intended under authorities of FAR 6.302-2(b)(1) & (2) and 13.106(b)(1). 11. I looked into the Interested vendors List and noted no vendors listed. I called Carol A. Lindsay at 443-740-2451 to ask if she had received any responses to her sources sought. She looked through her information and said that she had not. I then gave her the information for the sole source vendor to assist her in her solicitation. In my internet market research I only found a possibility in one other company. I will send a sources sought to see if they are able to provide complete workstation. If they are unable I will complete my sole source justification.
