- DESCRIPTION: The Department of Veterans Affairs Nebraska WesternIowa Health Care System (NWIHCS) intends to negotiate a commercial (FARPart 12) sole source contract with R S Stover Company under theauthority of FAR 6.302-1. The solicitation document and incorporatedprovisions and clauses are those in effect through Federal AcquisitionCircular (FAC) FAC 2005-34. Only one responsible source and no othersupplies or services will satisfy agency requirements. A justificationfor other than full and open competition is being prepared in support ofthis acquisition and will be posted separately as a modification to thisnotice. ITEMS BEING PROCURED ARE AS FOLLOWS: Contractor will provide all labor,material and equipment required to remove existing deteriorated fillmaterial from each of the three central air conditioning system coolingtower cells and provide new fill material (MX625 fill replacementincludes fill sheets, hardware to reinstall support tubes and columncovers) at the Grand Island VAMC, 2201 North Broadwell, Grand Island, NE68803. RATIONALE FOR SOLE-SOURCE PURCHASE: The current cooling tower cellsystem in place at the Grand Island VAMC is made by SPX CoolingTechnologies, Inc. SPX Cooling Technologies, Inc. has informed the VAthat R S Stover Company is the sole authorized representative for theirproducts for Grand Island, NE. Consequently, the equipment must beserviced by R S Stover Company to eliminate voiding warranties andensuring the equipment is maintained by an authorized representative. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. All proposalsreceived by 4:00 P.M. Central Time, August 17, 2009, will be consideredby the Government. A determination by the Government not to competethis proposed contract based on responses to this notice is solelywithin the discretion of the Government. Information received will beconsidered solely for the purpose of determining whether to conduct acompetitive procurement.
