- July 29, 2009 JUSTIFICATION FOR OTHER THEN FULL AND OPEN COMPETITION IN ACCORDANCE WITH FAR 13.106(b)(2) and 6.302-2(b) 1. The South Texas Veterans Health Care System, Audie L. Murphy Division, has requested a consignment agreement be established with EV3 to furnish their implantable stents - 411 pieces. Their request to establish a consignment agreement with EV3 has been agreed upon and approved by appropriate Medical Center Officials. This request is in accordance with FAR 13.501 (a) (2) (ii). 2. The requirement is for the consignment of implantable stents used in the vascular surgery unit for the repair and limb salvage on critical patients. 3. Vascular Surgery has a requested a consignment agreement for implantable stents. Estimated cost for this consignment is $499,999.00. 4. In accordance with 10. U.SC. 2304(c)(2), 41 U.S.C. 253(c)(2), Federal Acquisition Regulation (FAR) 13.106-1(b)(2) and 6.302-2(b). 5. These items are used for vascular surgical repair and limb salvage on critical patients. This request is critical to the veteran patients in the surgical unit. This consignment is critical to the life and longevity of veterans. 6. A Combined Synopsis and Solicitation will not be posted in the Federal Business Opportunity System (BOS), under FAR authority 6.302-2(b), due to the criticality of needed implants for the surgical unit. 7. It is anticipated that the negotiated cost to the Government for this procurement will be fair and reasonable based on historical pricing on other similar type stents. 8. Market research: there are no known contracts with the government, and the sales of these services are sold competitively in the commercial marketplace. There are not other companies that were listed when researching the World Wide Web (www) for specific stents. As a result of the market research it was determined that only one company could provide the required items, so in accordance with FAR Part 13.106(b)(2) procurement action was initiated. 9. The veteran patients who are waiting surgery are reliant upon implanted grafts. To alter customer specifications would add additional time to retrain staff on new stents and process. This would also disrupt surgery time and a high risk of veteran's life. EV3 is a large company, registered in CCR and not on debarred listings. 10. Only one responsible source is intended under authorities of FAR 6.302-2(b) and 13.106(b)(2). 11.
