- RECOVERY ACTION. This action is a Work Authorization issued under M&O Contract number DE-AC05-00OR22800 which is funded by Recovery Act dollars. The description of the work involved under this Work Authorization is as follows: The current American Recovery and Reinvestment Act (ARRA) scope of work is awarded under an existing M&O contract and consists of the demolition of five facilities, the removal of legacy material in part or total from 2 facilities, decontamination and decommissioning (D&D) of a filter housing in a single facility, and the remediation of two facilities/areas. Specific projects include: Removal of All Legacy Material from 9201-5 (Alpha-5); Removal of Legacy Material from the second floor of 9204-4 (Beta-4); Demolition of Buildings 9211, 9220, 9224, 9769; Deactivation and Demolition of Building 9206 bag filter house and associated recovery furnace; Demolition of Building 9735; Salvage Yard Remediation; and West End Mercury Area (Storm Sewer) Remediation. The actual Work Authorization Directive will be posted at http://www.doeal.gov/mocd/Y12T.aspx under modification M186 on or before July 17, 2009. Justification for Non-Fixed Price and/or competitive award: Contract clause DEAR 970.5243-11 Changes (December 2000), of the contract authorizes the Contracting Officer to make changes within the general scope of the M&O contract. The work scope considered for acceleration as a result of the receipt of the ARRA funds is clearly within the scope of the contract. The prospects for performing the ARRA scope of work under a firm fixed-price (FFP) contract were considered prior to issuance of the modification. The work contemplated is highly complex and many variables exist that do not lend themselves to the use of a fixed-price contract (FAR 16.601(c)). NNSA Y-12 Site Office has communicated to the M&O contractor that FFP subcontracts shall be utilized to the maximum extent possible in accomplishing the work executed with ARRA funding.
