Description
THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c) (1), set forth in Federal Acquisition Regulation 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." The 59th Test and Evaluation Squadron at Nellis AFB Las Vegas, NV, 89191 requires the purchase of maintenance and support for specific laboratory instrument. The 99th Contracting Squadron intends to make an award to Entron Systems Company of 815 N. Downs Street Suite C, Ridgecrest, CA 93555. Interested parties may e-mail stephen.colton@nellis.af.mil or fax 702-652-5405, Attn: Stephen Colton, not later than Friday, 24 July 2009; 4:00 p.m. Pacific Time. Per FAR Part 5.207-13(e) Fed Biz Ops Numbered Note 22 applies and is modified to read: 22. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within seven days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. V. DEMONSTRATION THAT THE CONTRACTORS UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) Entron Systems Company, of Ridgecrest, CA, is the only vendor with the ability to provide the required maintenance and support.. Entron is the the original manufacturer and contractor of the laboratory instruments. Entron's proprietary data, engineering schematics and innovations must be protected. To procure the maintenance and support from a company, other than Entron would result in another company having to design and manufacture a complete new product.. To replicate the engineering and manufacturing tasks similar to those of Entron, would cost the Government several hundred thousand dollars, far exceeding the current Goverment estimate. In summary, to procure the required maintenance and support from any company, other than Entron would result in substantial duplication of cost not expected to be recovered through full and open competition.
