- RECOVERY – This notice is provided for information purposes only. The U.S. Department of Agriculture, Agricultural Research Service (ARS) awarded a firm-fixed price modification to an existing task order to update the design for major renovations to the National Center for Agricultural Utilization Research to address deferred maintenance of critical mechanical, electrical, and plumbing systems, and incidental repairs (Phases 3 & 4). The task order was issued against an existing contract which was competed under the Brooks Act and awarded as an Architect and Engineering, Indefinite-Delivery/Indefinite-Quantity Contract. This contract modification is to update the existing design and provide construction administration and oversight during construction. In order to maintain a single source of liability, if any correction, revisions, or additions are required to be made to the project, they are required to be made by the professional engineer, or a representative within the company, who originally signed and sealed the documents. The original engineering documents for the project were signed, sealed, and dated by a professional engineer employed by Bernard Johnson Corporation who had prepared and approved the documents. As such, Bernard Johnson Corporation assumes liability for the design represented by the project engineering document.
