- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation proposals are being requested and a written solicitation will not be issued. There is no solicitation number, for reference use PR Number W91N5Y91840385. The NAICS code is 713940 with a SIC of 7991. The Army Test and Evaluation Command is soliciting a sole source commercial-item purchase order (under FAR Parts 12 and 13.5) with Xsport Fitness, Alexandria, Virginia. Proposed acquisition is to provide work-out facility for military assigned to HQ, ATEC, 4501 Ford Ave, Alexandria, VA. This results in the potential usage to be as high as 130. The Government intends to solicit and negotiate with only one source under the authority of FAR Part 13.106-1 and 10 U.S.C. 2304(c)(1) FAR 6.302-1. The Command requires an exercise facility in order for military personnel to meet Army fitness standards. The facility must: a. be within walking distance as junior personnel do not have personal transportation due to the high cost of parking. 4501 Ford Avenue has no shower facilities and personnel must be able to go and return from exercise ready to work in an office environment. b. have state-of-the-art facilities that meet all potential exercise profile limitations, to include swimming. Multiple visits per day must be included at no extra cost as personnel on a weight program must work out twice a day, and c. have extended business hours to facilitate personnel who must work out either before the start of the duty day or after hours. Provisions at FAR 52.212-1, Instructions to Offers-Commercial and FAR 52.212-4, Contract Terms and Conditions-Commercial Items apply to this acquisition. Offerors need to include a complete copy of the provisions at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items with their offer (registered in CCR, DUNS Number, Cage Code, and Tax ID Number). The clause at 52.212-5, Contract Terms and Conditions required to implement Statues of Executive Orders-Commercial Items, applies to this acquisition. Clauses include: 52.222-26, Equal Opportunity; 52.222-35, Affirmative Action for Disabled Veterans and Veterans of the Vietnam Era; 52.222-36, Affirmative Action for Workers with Disabilities; 52.222-37, Employment Reports of Disabled Veterans and Veterans of the Vietnam Era; and 52.232-36 Payment by Third Party. All responsible sources may submit a proposal, which shall be considered. All costs must be included in the offer. Offers are due before 1300 CST, 17 July 2009.
