CombinedSynopsis-Solicitation_Attch2(Clauses)_RXN265 CombinedSynopsis-Solicitation_Attch1(Specs)_RXN265 CombinedSynopsis-Solicitation_RFP_RXN265 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, in conjunction with FAR 13.5, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; and a written solicitation will not be issued. The solicitation number is HSCG23-09-R-RXN265 and is issued as a request for proposal (RFP). The solicitation document and incorporated provision and clauses are those in effect through Federal Acquisition Circular 2005-32. The North American Industrial Classification System (NAICS) code for this procurement is 541519 (size standard: $25.0 Million). The Coast Guard intends to obtain an RF Patrol Remote Monitoring System on a sole-source basis in accordance with (IAW) FAR 6.302-1 from SystemWare, Inc (SWI) IAW Attachment (1) to this combined synopsis/solicitation. As a result of this RFP, it is anticipated that a single Firm-fixed Priced type contract will be awarded in accordance with FAR 12.6. The RF Patrol Monitoring System is expected to be a Commercial-Off-The-Shelf (COTS) product. REQUIRED DELIVERY SCHEDULE: The Contractor shall ship all products within 120 days from the issuance of the Contract to the following location via any proposed shipping method, with standard delivery price(s) quoted as F.O.B. Destination. CG Security Center (ATTN: TechSec) 1441 Crossways Blvd (STE-102) Chesapeake, VA 23320-9553 WARRANTY TERMS & CONDITIONS: The vendor shall submit the terms and conditions for their standard commercial warranty offerings. BASIS FOR AWARD: The basis for award will be to the responsible vendor deemed technically acceptable with the lowest price determined to be fair and reasonable. It is solely within the Government's discretion to determine whether the vendor items proposed meet the required characteristics. The Government intends to evaluate proposals and award a single Contract without discussions. Therefore, each initial offer shall contain the best terms from a technical and price standpoint. The Government reserves the right to conduct discussions if determined necessary by the Contracting Officer. Contractors doing business with the Government are required to register in the Central Contractor Registration (CCR) database before they can be awarded a contract. A template containing the information for registration can be found at: http://www.ccr.gov. Contractors shall also submit a completed copy of provision at 52.212-3, Offeror Representations and Certifications – Commercial Items with their offer; OR confirm that this information is listed on the Online Representations and Certifications Application (ORCA) website found at https://orca.bpn.gov. The following provisions and clauses are applicable to this acquisition and can be found in Attachment (2) of this combined synopsis/solicitation which contains a listing of FAR and HSAR provisions and clauses applicable to this requirement: 52.212-1, Instructions to Offerors – Commercial 52.212-4, Contract Terms and Conditions – Commercial Items 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders – Commercial Items *NOTE: Additional applicable FAR clauses cited in clause 52.212-5 are marked in Attachment (2). Interested parties may identify their interests and capabilities to respond to the requirement or submit quotations. The USCG reserves the right to request product demonstrations at no charge to the Government. Proposals must be received no later than 12 Noon ET, 15 July 09, and shall be emailed to Todd.W.Blose@uscg.mil (any attachments should be in Word, Rich Text Format, or PDF and must not exceed 2 MB); or mailed to: Commandant (CG-9122) ATTN: Contract Specialist (TWB) United States Coast Guard Washington, DC 20593-7112 2100 2nd St SW STOP 7112 The point of contact (POC) for this acquisition is Contract Specialist, Mr. Todd W. Blose/CG-9122. Solicitation questions must be submitted NLT 4 PM ET on 13 July 09 to the POC via email at Todd.W.Blose@uscg.mil. ALL answers to questions will be posted on or before 12 Noon ET on 14 July 09. Questions received after the above cutoff date and time may not be answered. Submission of questions and any resulting answers from the Government will not require the Contracting Officer to extend the solicitation closing date. All Amendments to the solicitation will be posted via http://www.fedbizopps.gov. Note: The Government will not pay for costs incurred in the preparation and submission of proposals or other costs incurred in response to this announcement. NOTICE FOR FILING AGENCY PROTESTS: It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO). Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman. Informal forum with the Ombudsman: Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the USCG Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable). Formal Agency Protest with the Ombudsman: Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester’s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103. If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e).
