Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FA4528-09-M4013 Relocation of Fire Tower Training Facility Assembly I. CONTRACTING ACTIVITY: United States Air Force 5th Contracting Squadron/LGCAS 211 Missile Ave Minot AFB ND 58705-5027 II. NATURE AND/OR DESCRITPION OF THE ACTION BEING PROCESSED: The 5th Contracting Squadron intends to award a firm-fixed price purchase order on or about 19 Jun 2009 III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS: Require contracted services to relocate the fire tower training facility assembly currently housed in Building 2036 to a designated location on Minot AFB prior to construction of the assembly. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION: 10 USC 2304( c)(1), as implemented by FAR 6.302-1. V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY): The existing assembly comprises a fire tower training facility that was purchased in 2008, but stored on Minot AFB until the foundation for the facility was constructed and ready for the construction of the actual tower. The current storage facility is required for a higher-priority use, and the assembly must be moved prior to 15 July 2009. The assembly is still under warranty; movement of this assembly by any entity, other than the original vendor (who will assemble the tower at a later date) will void the warranty. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICIABLE: Competition for this acquisition is limited to the original vendor to maintain the warranty of the equipment. Future acquisitions will be monitored to decrease or negate the need to store the parts prior to actual erection of the facility. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE: Market research was performed to determine if the offer was fair and reasonable. Travel costs, labor hours, rental equipment costs and per diem rates were all reviewed and/or compared to current rates. The cost is determined to be fair and reasonable. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED: Because of the warranty for the assembly, no other vendors were contacted and asked to provide a proposal. Market research was conducted to ensure that the prospective vendor, Nielsen Building Systems, price was fair and reasonable, based on the rates available to the public. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION: N/A X. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITIION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED: At this time, this agency can take no actions to overcome competition barriers due to the nature of the equipment and requirement that the warranty remain valid. If, in the future, acquisitions of this nature will be carefully reviewed to ensure that the cost of additional movement is not required. XI. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION: See Section VI above. XII.
