Description
General Services Administration Public Building Service, Region 5 Minnesota/Wisconsin Service Center Justification for other than full and open competition in accordance with FAR 6.302-2 1. JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION This document constitutes justification and approval for other than full and open competition for the acquisition described herein, under the authority of FAR 6.302-2. It is executed on behalf of GSA/5PT5, Bishop Henry Whipple Federal Building, Fort Snelling, MN. 2. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED This office proposes to procure by means of other than full and open competition, the emergency repair of an elevator at the Gerald W. Heaney Federal Building & U.S. Courthouse in Duluth, MN. 3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS The proposed action involves procuring two bearings for the emergency repair of an elevator at Gerald W. Heaney Federal Building & U.S. Courthouse in Duluth, MN; total value $14,539.00. 4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION. A. FAR 5.202(a)(2) does not require that the action be synopsized. B. 10 U.S.C. 2304 (c)(2) or 41. U.S.C. 253(c)(2) permits limiting the number of sources. 5. DEMONSTRATE THAT THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED. Use of the statutory authority cited is FAR 6.302-2, only Unusual and Compelling Urgency is necessary because a delay in award of a contract could result in serious injury, financial or other, to the Government. There are only two elevators in the Gerald W. Heaney Federal Building & U.S. Courthouse. The elevators are approximately 75 years old. At this time, one elevator is handling all of the elevator service in the building because the other elevator is out of service due to a failed bearing. The failed bearing needs to be replaced as soon as possible so the building does not risk being without elevator service. Currently, the working elevator can not be taken out of service for routine repair without leaving the building with no elevator service. Furthermore, if the current elevator would become inoperable, the building would have no elevator service. Elevator service is essential to the safety of the building occupants, especially those with needs that inhibit their ability to use stairs. Using the current elevator maintenance contractor is the only way to expedite this repair due to the fact that they have extensive knowledge of the elevator and its operations and have all required security clearances on hand. 6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE The exception is FAR 5.202(a)(2) as this action is urgent and compelling. A competitively awarded contract is not feasible due to the need to immediately repair the elevator. 7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT FOR THE PROPOSED ACQUISITION WILL BE FAIR AND REASONABLE Through negotiations, it was determined that the agreed upon price of $14,539.00 for the bearing was fair and reasonable due to the age of the elevator and the need to expedite the custom manufacture of the bearing to retrofit the bearing within the machine housing. 8. DESCRIPTION OF MARKET SURVEY CONDUCTED AND THE RESULTS OR A STATEMENT OF THE REASONS THAT A MARKET SURVEY WAS NOT CONDUCTED No market survey was conducted due to the proposed contract action is made under unusual and compelling urgency, thus the solicitation will be sent to the current elevator maintenance contractor. 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION None. 10. LISTING OF SOURCES THAT EXPRESSED AN INTEREST IN THE PROCUREMENT None since this was not advertised on the FedBizOPPS website. 11. STATEMENT OF THE ACTIONS, IF ANY, TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION N/A. 12. STATEMENT OF DELIVERY REQUIREMENTS The contract is for 90 days after the award is issued.
