- This is a notice of intent to award a contract and is not a request for competitive proposals. The U.S. Department of Energy (DOE) intends to solicit a proposal and negotiate a sole source contract with Orbital Sciences Corporation. The contract will provide technical services on current and future projected U.S. space missions using radioisotope power systems (RPS) powered with Plutonium-238 (Pu-238) materials. This support is currently being performed by Orbital Sciences Corporation under task order number DE-AT01-04NE23856 and will expire on July 31, 2009. The services provided under this contract support key programmatic responsibilities and functions of the Office of Nuclear Energy (NE-34). Within NE is the Office of Radioisotope Power Systems (NE-34), which supplies Radioisotope Power Systems (RPS) to the National Aeronautics and Space Administration (NASA) for missions that are beyond the capabilities of fuel cells, solar power and battery power supplies. The Department has conducted extensive market research for this requirement including a source sought notice published on the Federal Business Opportunities website on September 23, 2008 and market research conducted with firms on the General Services Administration Professional Engineering Federal Supply Schedule in May/June 2009. Communication exchanges were conducted with ten (10) firms. Of the ten firms, only the incumbent has demonstrated capability sufficient to perform the requirement. Accordingly, this notice satisfies the requirement of FAR 5.203 and provides an opportunity for all responsible sources to submit a bid, proposal, or quotation for this effort consistent with the requirements identified below. Interested parties should identify their interest and specific capability to respond to the requirement. The information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. All proposals received by July 13, 2009 will be considered by the Government. The statutory authority for permitting other than full and open competition for this contract is Section 303(c)(1) of the Federal Property and Administrative Services Act of 1949, as amended by the Competition in Contracting Act, 41 U.S.C. 253(c)(1), and implemented by FAR 6.302-1., which authorizes other than full and open competition when there is only one responsible source and no other supplies or services will satisfy agency requirements; and when it is likely that an award to any other source may result in unacceptable delays in fulfilling the agency?s requirements. Orbital Sciences Corporation has the requisite number of key and non-key personnel possessing the required security clearances, technical skill and training to provide the highly specialized professional engineering service s. These personnel are also familiar with the program and the classified and unclassified requirements, and are available to provide immediate and continuing services. In addition, the majority of the personnel are required to have DOE ?Q? level security clearances (access authorizations) to perform work under this contract. Based on current experience, it frequently takes at least six (6) months and possibly as long as a year for the security clearance approval process to be completed.
