- THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract under statutory authority 10 USC 2304(c)(1), as implemented by Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Naval Facilities Engineering Command, Atlantic (NAVFAC LANT) requires Success Estimator software licensing, maintenance, and related support services. NAVFAC LANT intends to make an award to U.S. Cost, 600 Northpark Town Center, 1200 Abernathy Road NE, Building 600, Suite 950, Atlanta, GA.DESCRIPTION OF REQUIREMENT: Success Estimator cost estimating software licenses, access to software upgrades and enhancements, and related support services. The proposed contract action is for supplies and related services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. This notice of intent is not a request for competitive proposals. However, any firm believing it can meet the requirements may submit written notification via e-mail to Lee Ann White at leeann.white@navy.mil not later than 10 July 09, 4:00 p.m. EDT. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to satisfy the requirement. All submissions received by 10 Jul 09, 4:00 p.m. EDT will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY): In accordance with FAR 6.302-1(a)(2)(ii)(A), this enhancement is considered a follow on contract for the continued use of the Success Estimator cost estimating software and related services. Use of any cost estimating system other than Success Estimator would require extensive data conversion, retraining, licensing, certification and distribution, which would result in substantial duplication of cost that could not be recovered through competitive bidding. Therefore, acquisition of this requirement should be awarded on a sole-source basis, since U.S. Cost has proprietary rights pertaining to the software and related services required.
