- LOUIS STOKES CLEVELANDDEPARTMENT OF VETERANS AFFAIRS Medical Center 10000 Brecksville Road Brecksville OH 44141 JUSTIFICATION AND APPROVAL TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following justification, the use of other than full and open competition for the proposed contractual action is hereby approved pursuant to the authority of 41 U.S.C. 253(c)(2), and FAR 13.106-2, only one responsible source and no other supplies or services will satisfy agency requirements. JUSTIFICATION 1. Identification of Agency and Contracting Activity. The Louis Stokes Cleveland Department of Veterans Affairs Medical Center, 10000 Brecksville Road, Brecksville, Ohio, 44141, VISN 10 Contracting 90(C). 2. Nature/description of action. This activity proposes to solicit with Mobil Martin, using unusual and compelling urgency procurement procedures to provide the Louis Stokes Cleveland VA Medical Center with providing ambulance transport services. 3. Description of Supplies/Services. This requirement is for ambulance services for ambulance transports to include interfacility and special mode transports to cover the period of May 1, 2009 to May 31, 2009. Estimated Monthly Value: $300,000.00 EMS - Interfacility Special Mode (Ambulance) BOC 2112 4. Identification of Statutory Authority. The statutory authority permitting UNUSUAL AND COMPELLING URGENCY are 41 U.S.C. 253(c)(2) and FAR 6.302-2. 5. Demonstration of Contractor's Unique Qualifications. Description of contractor and or of acquisition action that demonstrates that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited: Mobil Martin currently provides this service to the Medical Center and continuation of ambulance service is needed at this time. FAR 6.302-2 does not require competition based on the agency's urgent need for the ambulance services which would result in adversely affecting patient care. This request is for payment of ambulance services for the month of May 2009. This will be an ongoing process until the ambulance contract is awarded. 6. Determination of Fair and Reasonable Cost. The Contracting Officer has determined that the anticipated cost to the Government will be fair and reasonable based on a comparison of prices. 7. Description of Market Survey. Due to the urgent nature of the need for this service, no market survey was conducted. 9. Any Other Supporting Data.
